RELEASE OF DEVELOPMENT AGREEMENT
(Government Code § 65868.5)
The CITY OF POWAY (hereinafter "City ") hereby declares as
follows:
1. The following described real property is the subject of
this Release (hereinafter "Subject Property "):
Parcel 106 of Parcel Map No. 16320 in the City
of Poway, County of San Diego, State of
California, filed in the Office of the County
Recorder of San Diego County.
2. All building and related improvements within all phases
of the development known as PARKWAY BUSINESS CENTRE with respect
to the above - described lot have been completed.
3. Upon the request of the owner of the Subject Property and
pursuant to the terms of that certain Development Agreement
executed between the City and owner's predecessor in interest
dated September 5, 1988, and recorded December 8, 1988, as File No.
88- 630853 of the official records of the Recorder of San Diego
County, said Development Agreement is hereby determined to be
canceled, released, and of no further force or effect as to the
Subject Property only.
4. This Release shall be binding upon and inure to the
benefit of each of the parties to the Development Agreement, and
their successors in interest.
