COVENANT REGARDING REAL PROPERTY
David W. Brooks Trust U/A dated September 25, 2007 ( "OWNER" hereinafter), is the owner of
real property commonly known as 13310 Del Poniente Road, Poway, CA ( "PROPERTY" hereinafter)
and more fully described as:
Lot 2 of City of Poway Tract 89 -09, in the City of Poway, County of San Diego, State of
California, According to Map thereof No. 14091, Filed in the Office of the County
Recorder of San Diego County, December 5, 2000.
In connection with the approval of Minor Development Review Application (MDRA) 13 -032 and
Building Permit B14 -0934, a request to construct a single - family home at the above - referenced
property by the City of Poway ( "CITY" hereinafter), OWNER hereby agrees to not oppose the granting
of a public trail easement overlapping a segment of Del Poniente Road through the Williams Ranch
Subdivision to the satisfaction of the City of Poway Director of Development Services.
This Covenant shall run with the land and be binding upon and inure to the benefit of future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party.
