Res 16-050RESOLUTION NO. 16-050 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, AMENDING THE LAKE OPERATIONS FEES WITHIN THE COMMUNITY SERVICES SECTION OF THE MASTER FEE SCHEDULE WHEREAS, California Code section 66016 et seq. establishes procedures for the adoption of fees for services by local government, WHEREAS, on May 4, 2010, the City Council adopted Resolution No. 10-017, adopting a Master Schedule of Fees, which includes fees for the Community Services Department; WHEREAS, on April 15, 2014, the City Council adopted Resolution No. 14-019, amending the Community Services Section of the Master Fee Schedule effective April 15, 2014; WHEREAS, on February 16, 2016, the City Council adopted Resolution No. 16- 002, amending the Poway Center for the Performing Arts fees within the Community Services Section of the Master Fee Schedule with fee changes taking effect on July 1, 2017, and subsequent fiscal years, and WHEREAS, it is necessary to amend the Community Services Section of the Master Fee Schedule to update the Lake Operations fees to offset the cost of Lake Poway operations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: The City Council finds that this amendment to the Master Fee Schedule is exempt from the requirements of CEQA pursuant to CEQA Guidelines Section 15273 (a) (1). Section 2: Those Lake Operations fees presented at this meeting, and set forth in Exhibit 1 to this Resolution, are hereby approved and adopted, and shall be effective December 1, 2016. Section 3: Effective December 1, 2016, the Community Services section of the City's Master Fee Schedule is deleted and replaced with the Community Services section to the Master Fee Schedule attached to this Resolution as Exhibit 1 as if set forth in the Master Fee Schedule in full, therein. Resolution No. 16-050 Page 2 Section 4: This Resolution shall become effective immediately provided, however, that the fees and charges contained in Exhibit 1 shall not take effect until December 1, 2016; the fees and charges contained in Exhibit 1 under the heading "FY18" shall not take effect until July 1, 2017; the fees and charges contained in Exhibit 1 under the heading "FY20" shall not take effect until July 1, 2019; and the fees and charges contained in Exhibit 1 under the heading "FY22" shall not take effect until July 1, 2021.
