AGREEMENT TO PAY PARK FEE
TENTATIVE PARCEL MAP NO. 82 -06
THIS AGREEMENT, made and entered into this day of
191'r , by and between the CITY OF POWAY, a municipal corporation,
hereinafter called "City ", and Michael Kwok -Choi Kan and Josephine
Waiin Kan, hereinafter called "Owners ":
WHEREAS, owners have submitted a tentative parcel map for the
division of land, which tentative map was conditionally approved
by the City of Poway on April 12, 1983; and
WHEREAS, as a condition of the approval of said tentative map,
the Park Fee shall be paid at the established rate, in accordance
with City Ordinance; and
WHEREAS, City Ordinance allows the deferral of the payment of
said fee until the time the first building permit is issued on
the parcels created by said division, provided said payment
is secured in an acceptable manner:
NOW, THEREFORE, in consideration of the premises contained
herein and the City's approval of the final map of said division
of land, the owners hereby agree as follows:
1. To pay the entire Park Fee prior to the issuance of the
first building permit on any of the parcels created by the
recordation of said map at the rate in effect at the time
the first said permit is issued.
2. The said Park Fee, if paid in full in cash at the time
of submitting this Agreement, is computed at $3,192.00.
IN WITNESS WHEREOF, the parties have caused this Agreement to
be executed on the day first above written.
