A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY CALIFORNIA,
ORDERING THE EXPUNGEMENT OF RECORD OF A NOTICE OF VIOLATION
AFFECTING PARCEL 3 OF PARCEL MAP NO 4857
RECORDED AUGUST 25 1995 OF OFFICIAL RECORDS

WHEREAS on July 11 1995 the City Council, adopted Resolution No. 95-079
ordering the recordation of a Notice of Violation for Parcel 3 of Parcel Map No 4857 for
violation of the Grading and Zoning Ordinances,
WHEREAS, said Notice of V'olation was recorded in the Office of the Recorder of
San Diego County on August 25, 1995, as document No. 1995-0376794,
WHEREAS on February 11 1997 the City approved Conditional Use Permit 97-
04 authorizing a horse boarding facility having up to 65 horses to operate on the
subject property in conjunction with the violations;
WHEREAS on November 28 2000 the City approved Grading Plan No G1259-
00 and subsequently issued a grading permit on December 7 2000 in conjunction with
the violations;
WHEREAS the mobile home cited in conjunction with the violations on the
property has been removed from the site
WHEREAS certain conditions were imposed in said Notice of Violation which
need to be accomplished before the violation could be expunged from the record and
WHEREAS the conditions of approval required of Conditional Use Permit 94-07
conditions calling for the approval of Grading Plan No. G1259-00 issuance of a grading
permit, remedial grading work and inspection by the City that all requirements have
been accomplished and removal of the mobile home from the property have all been
accomplished to the satisfaction of the Directors of Development Services and Safety
Services.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1 The City hereby declares that the Notice of Violation recorded on August
25 1995 as Document No 1995-0376794 of Official Records is of no
further force and effect.

2. The City Clerk of the City of Poway is directed to cause a certified copy of
the resolution to be recorded in the Office of the Recorder of San Diego
County The property owner shall provide the recordation fee to the City
Clerk.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
State of California, at a regular meeting this 9th day of April 2002.
