Res 03-087 RESOLUTION NO. 03-087 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA AMENDING THE DEVELOPMENT SERVICES DEPARTMENT FEE SCHEDULE WAIVING CERTAIN FEES PERTAINING TO THE REBUILDING OF STRUCTURES DAMAGED OR DESTROYED IN THE CEDAR FIRE OF OCTOBER 26, 2003 AND OCTOBER 27, 2003 WHEREAS, the City of Poway provides permit service to the citizens of Poway; and WHEREAS, the City Council has established certain fees for the cost of providing this service; and WHEREAS, on October 26, 2003 and October 27, 2003, the Cedar Fire consumed 6,887 acres within the City of Poway resulting in the loss of at least 54 homes, one business and numerous accessory structures, as well as damage to numerous structures; and WHEREAS, it has been determined that in many cases the property owner's insurance company will pay the cost of building permit and plan check fees; and WHEREAS, in order to help reduce the financial burden of the rebuilding process for property owners and residents of the City of Poway, the City Council finds that a modification to the Development Services Fee Schedule is warranted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: The City Council finds that the approval of this Resolution is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) because it entails the waiver or deferral of permit processing fees for property owners and residents wishing to rebuild after the Cedar Fire of October 2003, and there is no possibility this will have a significant effect on the environment. Section 2: The City Council hereby amends the Development Services Fee Schedule as follows for those properties that were damaged or destroyed during the Cedar Fire of October 2003: A. All building and planning fees for permits associated with clearing a destroyed house, establishing a temporary electrical power pole or moving temporary living quarters onto a property are hereby waived. B. The Minor Development Review fee is hereby waived. C. A hardship fee waiver process shall be established by the City Manager and administered by the Director of Development Services for property owners that Resolution No. 03-087 Page 2 did not have adequate insurance to cover the building permit and plan check fees necessary to rebuild the same sized structure that was lost. D. The payment of building permit and plan check fees not waived pursuant to this Resolution shall be deferred until the property owner has applied for reimbursement from the insurance company.
