CC 2003 10-14 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING OCTOBER 14, 2003 The October 14, 2003, Regular Meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna, at the Poway Community Park -Auditorium, 13094 Bowron Road, Poway, California. The following person was present wishing to speak: Nick Stavros, 13639 Jackrabbit Road, expressed his views on the Council's responsibilities under the Brown Act and Espola Road CONSENT CALENDAR Mayor Cafagna stated he had requests to remove Item Nos. 9, 12 and 14 from the Consent Calendar for discussion. Motion by Deputy Mayor Rexford, seconded by Councilmember Higginson, to approve the remainder of the Consent Calendar as follows: 4. Ratification of Warrant Registers for the Period of September 15-19, 2003. (401-10) 5. Approval of Minutes - City Council September 16, 2003 - Regular Meeting September 23, 2003 - Regular Meeting 7. (203-07) 14.1 Adoption of Resolution No. 03-080 - Supporting a Statewide Ballot Initiative to Require Voter Approval before State Government may take Local Tax Funds. Staff report by City Planner Brindle. This is a request to construct a 23,156-square- foot addition to the existing 17,557-square-foot temple facility located at 15905 Pomerado Road. APNs: 275-810-17, 18, and 19. The following people were present wishing to speak: Bennett Lord, 11650 Iberia Place, San Diego, Rep: Temple Adat Shalom & Lord Architecture Inc., spoke in support of the proposed project. Motion by Deputy Mayor Rexford, seconded by Councilmember Emery, to remove the item from calendar and re-notice it at a future date. In the interim, the applicant is to work with the neighborhood to try and resolve their differences. Motion carried unanimously. 7947 Page 4 - CITY OF POWAY - October 14, 2003 ITEM 2 (203-081203-10) MODIFICATION CONDITIONAL USE PERMIT 89-10M(4) MINOR DEVELOPMENT REVIEW APPLICATION 03-67 TRAIN BARN/OLD POWAY PARK CITY OF PQWAY, OWNER/APPLICANT Mayor Cafagna opened the public hearing. Introduction by Acting City Manager Riley. This is a request to construct an approximately 2,146-square-foot addition to the existing 2,500-square-foot train barn within the Old Poway Park located at 14134 Midland Road. APN: 314-202-16 through 30. The following people were present wishing to speak: Charles Cross, 13514 Mora Circle, representing the Poway Midland Railroad Volunteers, spoke in support of the proposed project. Dee Fleischman, 14428 Midland Road, inquired as to whether the window frames would be wood. Motion by Deputy Mayor Rexford, seconded by Councilmember Emery, to close the public hearing and adopt Planning Resolution No. P-03-63, entitled, "A Resolution of the City Council of the City of Poway, California Approving the Modification to Conditional Use Permit 89-10M(4) and Minor Development Review Application 03-67 to Construct an Addition to the Train Barn within the Old Poway Park APN: 314-202- 16 through 30." Motion carried unanimously. ITEM 3 (203-10) HILLSlDE/RIDGELINE MINOR DEVELOPMENT REVIEW APPLICATION 03-37 NICK ARTHMAN, APPLICANT Mayor Cafagna opened the public hearing. Introduction by Acting City Manager Riley. This is a request to construct a 4,665-square-foot, two-story, single-family residence, measuring a maximum height of thirty feet, on a 2.42-acre parcel located on the north side of Eastvale Road, east of Canyon Pass. APN: 278-240-37. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Deputy Mayor Rexford, to close the public hearing and adopt Planning Resolution No. P-03-64, entitled, "A Resolution of the City Council of the City of Poway, California Approving Minor Development Review Application (MDRA) 03-37 Assessor's Parcel Number 278-240-37." MICHAEL'S CHURCH Mayor Cafagna stated that a request from the public had been received to remove this item from the Consent Calendar for discussion. The following person was present wishing to speak: Dee Fleischman, 14428 Midland Road, stated her question had been answered. Motion by Deputy Mayor Rexford, seconded by Councilmember Higginson, to approve the release of Grading Securities for St. Michael's Church. Motion carried unanimously. ITEM 12 (1160-01 ) TIME RESTRICTED NO PARKING SOLERA WAY POMARD WAY TO WESTERN END Mayor Cafagna stated that Councilmember Emery had requested this item be removed from the Consent Calendar for discussion. Councilmember Emery made inquiry of staff regarding the letter received from Mr. Culbertson of Lomas Verdes Drive and his comments on where the parking ban should end. Motion by Councilmember Higginson, seconded by Councilmember Emery, to continue this item to allow staff time to review the options and bring back a report to the November 18, 2003, Council Meeting. Motion carried unanimously. ITEM 14 (602-01 #1638) WIRELESS TELECOMMUNICATIONS MASTER COMMUNICATIONS SITE ENCROACHMENT AGREEMENT SPRINT TELEPHONY P.C.S. Mayor Cafagna stated that Councilmember Goldby had requested this item be removed from the Consent Calendar for discussion. Concilmember Goldby inquired as to limits, placement and regulation of the boxes. Development Services Director Fritz responded that the agreement does not contain those standards, however, each request will require a Minor Development Application and will be brought before the Council for approval. 7949 Page 6 - CITY OF POWAY - October 14, 2003 Motion by Councilmember Goldby, seconded by Deputy Mayor Rexford, to approve the Master Communications Site Encroachment Agreement between the City and Sprint Telephony PCS. for wireless telecommunications facilities on light standards mast arms or poles in the public right-of-way. Motion carried unanimously. CITY MANAGER ITEMS 15. Acting City Manager Riley provided Council with a State Budget Update. (15O2-23 MAYOR AND CITY COUNCIL-INITIATED ITEMS 21A. Mayor Cafagna did not provide a Regional Governance update.
