Res P-17-13RESOLUTION NO. P-17-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA ADOPTING A MITIGATED NEGATIVE DECLARATION FOR MINOR DEVELOPMENT REVIEW APPLICATION 14-036 ASSESSOR'S PARCEL NUMBER: 275-712-10 WHEREAS, the City Council considered Minor Development Review Application (MDRA) 14-036, a request to construct a 1,574 square -foot addition to an existing residence at 16290 Rostrata Hill Road within the Rural Residential C (RR -C) zone, convert a detached garage/workshop to a 988 square -foot guest house, and construct a new attached 833 square -foot garage and workout room; and WHEREAS, on July 18, 2017, the City Council held a duly advertised public meeting to receive testimony from the public, both for and against, relative to this matter. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: In accordance with the requirements of the California Environmental Quality Act (CEQA) an Environmental Initial Study (EIS) and a proposed Mitigated Negative Declaration (MND), attached as Exhibit A, have been prepared for MDRA 14-036. The City Council has considered the EIS, MND and associated Mitigation Monitoring Program, and public comments received on the EIS and MND. The subject EIS and MND documentation are fully incorporated herein by this reference. The City Council finds, on the basis of the whole record before it, that there is no substantial evidence the project will have a significant impact on the environment, that the mitigation measures contained in the EIS included as Attachment 1 of the attached Exhibit A hereof will mitigate potentially significant impacts to a less than significant level, and that the MND reflects the independent judgment and analysis of the City. The City Council hereby adopts the MND and the associated Mitigation Monitoring Program attached to this Resolution as Attachment 2 of Exhibit A. Section 2: A Cultural Resources Survey report, dated August 5, 2015 was prepared by Meridian Archaeological Services & Research (MAS&R) on the property and for the proposal. Significance testing was performed in the area of the proposed development. MAS&R did not classify the rock outcroppings used for a milling station as significant under CEQA. A potential does exist that prior disturbances within the project area located just south of the rock outcroppings might mask archaeological deposits particularly in light of the property being in the vicinity of the Green Valley Creek, and the number of archaeological sites within one mile radius. Therefore, MAS&R recommends that a cultural monitoring program be implemented by a qualified archaeologist and a Native American Monitor during any type of soil removal from the Area of Potential Effect.
