A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
PROHIBITING OVERNIGHT PARKING
ON CITY-OWNED PROPERTIES
WHEREAS, California Vehicle Code Section 21113 allows cities to post special
parking restrictions on publicly owned property; and
WHEREAS, California Vehicle Code Section 22651 (n) allows any peace officer or
City employee who is engaged in directing traffic or enforcing parking laws and regulations
to remove a vehicle that is parked or left standing where local authorities, by resolution or
ordinance, have prohibited parking and have authorized the removal of vehicles, if signs
are posted giving notice of the removal; and
WHEREAS, Section 10.28.160 ofthe Poway Municipal Code allows the City Council
to establish no parking-towaway zones, such zones to be appropriately signed or marked,
and to prohibit any person from stopping, standing, or parking a vehicle in violation of the
restriction stated on or indicated by such signs or markings; and
-_. WHEREAS, Section 10.28.160 of the Poway Municipal Code further allows the
Chief of Police or any member of the California Highway Patrol to remove any vehicle left
parked or standing in violation of the no parking-towaway zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1. Overnight parking is prohibited on any property owned by the City of
Poway.
Section 2. This prohibition shall take effect once said property is posted with signs
reading as follows:
Overnight Parking is Prohibited
Unauthorized Vehicles Will be Towed Away at Owner's Expense

Section 3. Vehicles stopped, standing, or parking overnight on property
appropriately signed as described in Section 2 may be cited or removed by the Chief of
Police or any member of the California Highway Patrol.
