Res P-02-47 RESOLUTION NO. P-02-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 02-71 WHEREAS, Temporary Use Permit 02-71; City of Poway Community Services and the Poway Chamber of Commerce, Applicants, request approval to hold the Annual Poway Days from Sunday, September 1, 2002 through Monday, September 30, 2002. WHEREAS, on August 20, 2002, the City Council considered the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: The City Council finds that Temporary Use Permit 02-71 is exempt from the provisions of the California Environmental Quality Act (CEQA), as a Class 4 Categorical Exemption, pursuant to Section 15304(e) of the CEQA Guidelines. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approved Temporary Use Permit 02-71, the Annual Poway Days Events from September 1, 2002 until September 30, 2002, subject to the following conditions: A. The event and related offsite parking shall be conducted as shown on the site plan and application on file in the Development Services Department. B. This permit is valid during the hours of the scheduled events from Sunday September 1, 2002 through Monday, September 30, 2002, after which time the sites shall be restored to its original condition. C. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City ordinances presently in effect. D. Prior to all events, the applicants shall comply with the following: 1. The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Community Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Sheriff's Department. The San Diego County Health Department shall also be contacted. - Resolution No. P-02-47 Page 2 2. An insurance bond indemnifying the City from possible liability in an amount not less than $1 million for events that utilize City property shall be provided to the Development Services Department, Planning Division, by August 30, 2002. 3. Prior to the Business Decorating Contest, the Chamber of Commerce, as the applicant, shall ensure that all participants comply with Section 17.26.030(e), Outdoor Displays and Section 17.40.190, Temporary Signs, of the Poway Municipal Code. Participants should be encouraged to contact the Development Services Department regarding the use of outdoor displays and temporary signs. E. During all events, the applicants shall comply with following: 1. Prior to and during the event, emergency vehicle access to any building, fire hydrant, or fire sprinkler system connection shall not be blocked. 2. Obtain a permit from the Fire Department for any canopy that is over 400 square feet. 3. Obtain a permit from the Fire Department for fireworks show. 4. Obtain a permit from the Fire Department for the Pig in the Pit Barbecue. 5. The applicant shall comply with Chapter 6.24 of the Poway Municipal Code regulating the treatment of rodeo animals, F. During the Poway Days Heritage Parade, the Chamber of Commerce, as the applicant, shall ensure that: 1. The westbound lanes of Poway Road shall be kept open for emergency vehicles. Street intersections along the parade route shall be kept clear of spectators for emergency traffic. 2. Barricades and cones shall be placed along the parade and detour routes. G. During all Rodeo events, the Chamber of Commerce shall ensure that: 1. A temporary "NO PARKING, TOW-AWAY ZONE" shall be established on the west side of Tierra Bonita Road from Donart Drive north to Poway Valley Road, to provide a wider pedestrian walking area into and out of the PVRA grounds, and to ensure sufficient access for emergency vehicles - fire, paramedic and law enforcement. "NO PARKING" signs shall be placed along this area approximately 250 feet on center. - Resolution No, P- 02-47 Page 3 2. In all unpaved parking areas, temporary markers shall be provided to delineate parking areas and aisles and to ensure that no parking occurs within 100 feet of any existing residential structure. 3. A designated area for police, fire and paramedic units out of the main activity areas and adjacent to the south vehicle gate of the PVRA property shall be provided. 4. A copy of the agreement with the adjacent property owner(s) for parking rights shall be provided to the Development Services Department, Planning Division prior to September 6, 2002. 5. The applicants shall ensure that the event is in compliance with Chapter 6.24 of the Poway Municipal Code regulating the treatment of rodeo animals. H. At the conclusion of all events, the applicants shall comply with the following: 1. Public streets, off-street parking sites and areas within and adjoining to the proposed area for the event, shall be cleared of debris, litter, temporary signs, and all other evidence of the event shall be removed upon its completion. Section 4: This approval shall become null and void on October 1, 2002 at 1 :00 a.m., at which time the sites utilized shall have been restored to its original condition.
