Res P-02-53 RESOLUTION NO. P-02-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 02-87 WHEREAS, Temporary Use Permit 02-87; City of Poway Community Services, Applicant, requests approval to hold the Annual Train Song Festival at Old Poway Park located at 14134 Midland Road, on Saturday, October 5,2002, from 10:00 a.m. to 4:00 p.m. WHEREAS, on September 17, 2002, the City Council considered the above- referenced item. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: The City Council finds that Temporary Use Permit 02-87 is exempt from the provisions of the California Environmental Quality Act (CEQA), as a Class 4 Categorical Exemption, pursuant to Section 15304(e) of the CEQA Guidelines. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approved Temporary Use Permit 02-87, the Annual Train Song Festival at the Old Poway Park, located at 14134 Midland Road, on Saturday, October 5, 2002, from 10:00 a.m. to 4:00 p.m., subject to the following conditions: A. The event and related offsite parking shall be conducted as shown on the site plan and application on file in the Development Services Department. B. This permit is valid during the hours of 10:00 a.m. to 4:00 p.m. on Saturday, October 5, 2002, after which time the site shall be restored to its original condition. C. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. D. Prior to all events, the applicant shall comply with the following: 1. The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Community Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Resolution No. P-02-53 Page 2 Sheriff's Department. The San Diego County Health Department shall also be contacted. 2. All proposed signs shall be approved by the Development Services Department, Planning Division, and shall be in accordance with Section 17.40 of the Poway Municipal Code. E. The applicant shall comply with the following to the satisfaction of the Fire Marshal: 1. Prior to and during the event, emergency vehicle access to any building, fire hydrant, or fire sprinkler system connection shall not be blocked. 2. Provide a 2A:10BC fire extinguisher at any booth where cooking is done. 3. All compressed gas cylinders shall be secured. F. At the conclusion of the event, the applicant shall comply with the following: 1. Public streets, off-street parking sites and areas within and adjoining to the proposed area for the event, shall be cleared of debris, litter, temporary signs, and all other evidence of the event shall be removed upon its completion. Section 4: This approval shall become null and void on October 5, 2002 at 6:00 p.m., at which time the sites utilized shall have been restored to its original condition.
