RESOLUTION NO. P-02-62
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 02-102
WHEREAS, Temporary Use Permit 02-102; Poway Chamber of Commerce,
Applicant, requests approval to hold the annual Poway Fall Fest Street Fair on Midland
Road on Sunday, November 10, 2002, from 10:00 a.m. to 4:00 p.m.
WHEREAS, on October 29, 2002, the City Council considered the above-
referenced item.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: The City Council finds that Temporary Use Permit 02-102 is exempt from the
provisions of the California Environmental Quality Act (CEQA), as a Class 4 Categorical
Exemption, pursuant to Section 15304(e) of the CEQA Guidelines.
Section 2: The proposed use is in accordance with the purposes and standards of
Section 17.26.030.A of the Poway Municipal Code.
Section 3: The City Council hereby approved Temporary Use Permit 02-102, the
annual Poway Fall Fest Street Fair, to be held on Midland Road between Poway Road
and Hilleary Place, on Sunday, November 10, 2002, from 10:00 a.m. to 4:00 p.m.,
subject to the following conditions:
A. The event and related offsite parking shall be conducted as shown on the site
plan and application on file in the Development Services Department.
B. This permit is valid during the hours of 10:00 a.m. to 4:00 p.m. on Sunday,
November 10, 2002, after which time the site shall be restored to its original
condition.
C. The barricades can be placed at 5:00 a.m. and shall be removed by 6:30 p.m. on
November 10, 2002.
D. Approval of this activity shall not excuse compliance with all other sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.
E. The site shall be developed in accordance with the approved site plan dated and
on file in the Development Services Department, Planning Division, except as
may otherwise be provided herein, prior to commencement of the activity.
F, Prior to all events, the applicant shallt:omply with the following:

1. The following City of Poway departments shall be contacted for
appropriate permits, coordination, and inspections: Public Works,
Community Services, Development Services (including the Building,
Traffic Engineering, and Planning Divisions), Safety Services, and the
Sheriff's Department. The San Diego County Health Department shall
also be contacted.
2. Provide a traffic control plan to the satisfaction of the Traffic Engineer
showing how traffic will be detoured with the closure of Midland Road.
Plan must be submitted for approval to the Development Services
Department, Traffic Engineering Division, one week prior to the event.
3. Written permission from the property owners who will allow parking for the
event is required to be on file in the Development Services Department,
Planning Division.
4. Provide the City and insurance policy naming the City as additionally
insured for a minimum of $1 million dollars.
5. A copy of a signed waiver of liability is to be on file with the City of Poway
Development Services Department, Planning Division, covering the event,
participants, and City equipment used during the event.
6. Signs shall be posted on Midland Road giving the particulars of dates and
times of closure one week prior to the event. All signage shall be in
conformance with the temporary signage provisions of the Poway
Municipal Code. Contact the Development Services Department, Planning
Division, regarding the temporary sign ordinance prior to the installation of
any sign.
7. Vendor's licenses shall be obtained from the City of Poway Customer
Services Department for all temporary sales locations.
8. Notify, in writing, Midland Road businesses, the United States Post Office,
the Silver Oaks Apartment property manager, and residents affected by
the road closure. The notices shall be mailed or hand delivered. The
notice shall include the details of the date and time of the event, and the
area of the road to be closed.
9. The applicant shall have designated at all times, and at specific locations,
to provide liaison with representatives of the City's Safety Services and
Sheriff's Departments.

10. An alternative City bus route/stop plan for Midland Road shall be provided
and approved by the Community Services Department prior to the event.
G. The applicant shall comply with the following to the satisfaction of the Fire
Marshal:
1. Prior to and during the event, emergency vehicle access to any street,
building, fire hydrant, or fire sprinkler system connection shall not be
blocked.
2. Any booth where cooking food is being prepared must have a fire
extinguisher with a minimum rating of 2A:10BC.
3. All compressed gas cylinders must be secured from falling over.
4. A permit for any canopy that exceeds 400 square feet must be obtained
from the Fire Department.
H. At the conclusion of the event, the applicant shall comply with the following:
1. Public streets, off-street parking sites and areas within and adjoining to the
proposed area for the event, shall be cleared of debris, litter, temporary
signs, and all other evidence of the event shall be removed upon its
completion. .
Section 4: This approval shall become null and void on November 10, 2002 at 7:00
p.m., at which time the sites utilized shall have been restored to their original condition.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 29th day of October 2002.
