RESOLUTION NO. P-02-70
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
RESCINDING RESOLUTION NOS. P-00-19 AND P-00-88
PERTAINING TO TENTATIVE PARCEL MAP NO. 99-04
ASSESSOR'S PARCEL NUMBER 273-100-04
WHEREAS, heretofore, the City Council adopted Resolution No. P-00-19
approving the Mitigated Negative Declaration and Tentative Parcel Map 99-04 (TPM 99-
04) for Assessor's Parcel Number 273-100-04; and
WHEREAS, on November 14, 2001 the City Council adopted Resolution No. P-
00-88 suspending activity pursuant to Resolution No. P-00-19 by order of the San Diego
Superior Court during the appeal of San Diego Superior Court Case No. GIC746770.
and
WHEREAS, a Settlement Agreement has been entered into by the parties of San
Diego Superior Court Case No. GIC746770 and the agreement stipulated that the City
Council shall rescind its approval of TPM 99-04.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: The above statements are hereby incorporated into this Resolution as
findings.
Section 2: Resolution No. P-00-19 and Resolution No. P-00-88 are hereby rescinded.
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
State of California, and this 19th day of November 2002.
