A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, OPPOSING SECTIONS OF'
ASSEMBLY BILL (AB) 805 CHANGING THE VOTING
STRUCTURE OF THE SAN DIEGO ASSOCIATION OF
GOVERNMENTS (SANDAG) AND DENYING SAN DIEGO
COUNTY VOTERS THE RIGHT TO VOTE ON CHANGES
TO THE SANDAG GOVERNANCE STRUCTURE
WHEREAS, on September 20, 2016, the City Council adopted the City's 2016
Legislative Platform to convey the City's position on important policy issues;
WHEREAS, per the Legislative Platform the City opposes legislation that limits
local control;
WHEREAS, Assembly Bill (AB) 805 proposes to substantially change the voting
structure at the San Diego Association of Governments (SANDAG) and the
Metropolitan Transit System (MTS) giving substantial control of the agenda, votes, and
programming of regional funds to the cities of San Diego and Chula Vista;
WHEREAS, on May 2, 2017, the City Council passed Resolution 17-011 expressing
opposition to key provisions of AB 805 that change SANDAG's and MTS's governance
structure;
WHEREAS, the SANDAG board has demonstrated the ability to address issues
without a state mandate by acting decisively to hire an outside law firm to investigate
issues surrounding revenue projections for Measure A and is now in the process of
addressing the findings of the law firm's final report;
WHEREAS, amendments to AB 805 introduced since the passage of Resolution 17-
011 have failed to address the City's key concerns with changes to the SANDAG
governance structure; and
WHEREAS, the most recent amendments to the bill are anti -democratic in that they
eliminate the right of local voters to vote on proposed changes to the SANDAG governance
structure unless the changes are consistent with and do not conflict with state law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: The City will continue to vigorously oppose those sections of AB 805
changing the voting structure at SANDAG from a combination tally and weighted vote to
allowing the weighted vote to override the tally vote due to the profoundly negative
impact these changes would have on the City of Poway including marginalizing the
power of the City's vote on the use of regional transportation dollars and likely limiting
access to those transportation dollars in the future.

Section 2: State legislation that infringes upon the rights of local voters to vote on
local issues runs afoul of the democratic process. The City adamantly opposes the
amendment to AB 805 that denies San Diego County voters the right to vote on
SANDAG governance changes.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
California, at a special meeting this 31st day of August 2017.
