Res P-04-04 RESOLUTION NO. P-04- 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 03-128 TO HOLD THE POWAY FAMILY DAY AT POWAY COMMUNITY PARK WHEREAS, Temporary Use Permit 03-128; City of Poway Community Services Department, Applicant, requests approval to hold the Poway Family Day on Sunday, January 18, 2004, from 9:00 a.m. to 4:00 p.m., and WHEREAS, on January 13, 2004, the City Council considered the above- referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: The City Council finds that Temporary Use Permit 03-128 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no permanent effects on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 03-128, the Poway Family Day at Poway Community Park, located at 13094 Civic Center Drive, on Sunday, January 18, 2004, from 9:00 a.m. to 4:00 p.m. subject to the following conditions: A. The event and related off-site parking shall be conducted as shown on the site plan and application on file in the Development Services Department. B. This permit is valid during the hours of 9:00 a.m. to 4:00 p.m. on Sunday, January 18, 2004, after which time the site shall be restored to its original condition. C. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. D. Prior to the event, the applicant shall comply with the following: 1. The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Resolution No. P-04- 04 Page 2 Community Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Sheriff's Department. The San Diego County Health Department shall also be contacted. 2. All proposed signs shall be approved by the Development Services Department, Planning Division, and shall be in accordance with Section 17.40 of the Poway Municipal Code. 3. Obtain a permit from the Fire Department for any canopy that exceeds 400 square feet. E. During the event, the applicant shall comply with following: 1. Prior to and during the event, emergency vehicle access to any street, fire lane, building, fire hydrant, or fire sprinkler system connection shall not be blocked. 2. Provide a fire extinguisher with a minimum rating of 2A:10BC at any booth where cooking food will take place. 3. Secure any compressed gas cylinders from falling over. F. At the conclusion of all events, the applicants shall comply with the following: 1. Public streets, off-street parking sites, and areas within and adjoining the proposed area for the event, shall be cleared of debris, litter, temporary signs, and all other evidence of the event shall be removed upon its completion. Section 4: This approval shall become null and void on January 18, 2004, at 4:00 p.m., at which time the site utilized shall have been restored to its original condition.
