Grant of Right of Way 1978-185338 4 • DOCUMENTARY TRANSFER TAX- • 2127 '78- 185338 GRANT OF RIGHT OF WAY Jr- e-fid CLEMENT L. HIRSCH, a married man , as Grantor, for and in consideration of the sum of One Dollar and other valuable consideration paid by POWAY MUNICIPAL WATER DISTRICT, a public corporation as Grantee,receipt whereof is hereby acknowledged,do hereby grant to said POWAY MUNICIPAL WATER DISTRICT its successors and assigns,an easement of right of way.XXXXxXXXXXXXXKYYX X ]i in,upon,over,under,and across the lands hereinafter described, to erect,construct,reconstruct, replace, repair,maintain and use a pipeline or pipelines for any and all purposes,together with their necessary fixtures and appurtenances including but not limited to facilities for power transmission and communication purposes,at such locations and elevations,upon,along,over and under the hereinafter described right of way as Grantee may now or hereafter deem convenient and necessary from time to rime,together with the right of ingress thereto and egress therefrom,to and along said right of way by a practical route or routes in,upon,over and across the hereinafter described lands,together with the right to use said right of way for access to Grantee's rights of way situated in adjacent lands. The lands in which said easement of right of way is hereby granted are-situated in the County of San Diego State of California,and are particularly described as follows,to wit: That portion of Section 31, Township 13 South, Range 1 West, in the County of San Diego, State of California , according to United States Government Survey, described as follows: Commencing at the Northeast corner of the South 300.00 feet of the North Half of the Southeast Quarter of said Section 31; thence Northerly along the Easterly line of said Section 31 a distance of 400.00 feet to the TRUE POINT OF BEGINNING; thence Southwesterly along a straight line to a point on the Northerly line of the South 300.00 feet of said North Half of the Southeast Quarter, distant thereon 1000.00 feet Westerly from the Easterly line of said Section 31; thence Westerly along said Northerly line to the Westerly boundary of the San Diego Aqueduct as described in Lis Pendens under Civil Code No. 675, recorded November 21, 1945 in Book 1986, page 1 of Official Records; thence Northerly along said Westerly boundary to the Southerly line of the Northeast Quarter of said Section 31; thence Westerly along said Southerly line to the Easterly boundary of County Road Survey No. 335 (known as Espola Road) ; thence Northerly along said Easterly boundary to the Northerly boundary of said Section,31; thence along said Northerly boundary South 89°40'30" East to a point distant there along 1282. 25 feet Easterly from the North Quarter corner of said Section 31, being the Northwesterly corner of land described in Parcel 2 in deed to Poway Municipal Water District, recorded June 29, 1971 as File No. 138918; thence along the Westerly line of said land South 00°19'30" West, 266. 12 feet to the Northwesterly prolongation of the Southwesterly line of land described in Parcel "A" in deed to Poway Municipal Water District, recorded May 4, 1964 as File No. 79320; thence along said prolongation said Southwesterly line and the Southeasterly prolongation thereof, South 64°59'45" East to the Easterly line of said Section 31; thence Southerly along said Easterly line to the TRUE POINT OF BEGINNING. ( JO IsunOxe MIs XV alego:• a3!s1ye �r 9` . r .6p Nr, ft..+ a .. • �`':., 4 +i ta r• - 1l11111111111131111atud easement of right of way in the aforesaid lands is particularly described as follows: PARCEL 1: All that portion of the lands first above described included within a strip of land 20.00 feet of even width, the Easterly line of said 20.00 foot wide 2128 strip of land lying 25.00 feet Westerly of, measured at right angles and radially, from. the Westerly line of that certain 100.00 foot wide right of way as condemned by the UNITED STATES OF AMERICA, Southern District of California, Southern Division Case No. 675-SD Civil, a certified copy of which was recorded November 17, 1949, in Book 3389, Page 442 of Official Records. PARCEL 2: • All that portion of the Southerly 30.00 feet of the Northeast Quarter of said Section 31 lying Westerly of the Westerly line of the 20.00 foot wide strip of land described in Parcel 1 above. PARCEL 3: An easement for ingress to, and egress from the land described in Parcels 1 and 2 above, and also for the purpose of constructing, reconstructing, replacing, and repairing, and maintaining the hereinbefore mentioned pipeline or pipelines, and any and all appurtenances incidental thereto constructed within said land des- cribed in Parcels 1 and 2 above, over, under, upon and across all that portion of said lands first above described lying within a strip of land 10.00 feet of even width, said 10.00 foot wide strip of land lying Easterly of and immediately adjoining the 20.00 foot wide strip of land described in Parcel 1 above. TOGETHER WITH an easement for a temporary working strip of land, situated within the lands first above described, said easement shall include, but not be limited to, the right and privilege of workmen, contractors, and any and all agents employed by the Grantee herein, to use and occupy said tem- porary working strip for the purpose of constructing the hereinbefore mentioned pipeline or pipelines, and any and all appurtenances incidental thereto, and said easement shall include the right and privilege to place and operate any and all machinery on said strip which the Grantee herein, or any agent or contractor employed by said Grantee, deems necessary for the construction of said pipeline or pipelines. Said temporary working strip hereinabove referred to being more particularly described -as follows: All that portion of said lands first above described lying within a continuous strip of land 40.00 feet of even width, said 40.00 foot wide strip of land lying Westerly of and Northerly of, respectively, the 20.00 foot wide and 30.00 foot wide strips of land described in Parcels 1 and 2 above. It is hereby understood and agreed upon by the Grantor and Grantee herein, that the right and privilege set forth for the use of the above described temporary working strip shall be in full force and effect from the date of execution of this instrument, and shall continue in full during the construction of said pipeline, and that upon completion, final inspection, and acceptance of the pipeline by said Grantee herein, the easement for the temporary working strip hereby granted and described above, shall cease and terminate, and become of no further force or effect. It is also understood and agreed upon by the Grantor and Grantee herein, that the grant and termination of the easement for the temporary working strip herein- above described shall in no way affect or frustrate the continued enjoyment and use of the easements described in Parcels 1, 2, and 3 above. ,., Notwithstanding any provision of this Grant of Fight of Way, Grantor reserves to himself and his successors the following rights as to all or any portion of the right of way , all of which rights are to be exercised (a) without cost, expense or liability of any kind to Grantee , (b) only upon reasonable notice to Grantee, (c) only if done in such a manner as to not interfere with the continuous operation and maintenance of Grantee 's existina or future pipelines and appurtenances , (d) in accordance with Grantee ' s engineering standards , and (e) with the express under- standing that Grantee may from time to time reconstruct, alter and improve any works of Grantee within the right of way : (1) grade and pave the same , (2) dedicate the same for public streets , and (3) relocate the same and any pipeline and appurtenance therein provided Grantee is provided with substitute rights of way and relocated facilities of equal or better characteristics . Grantor and his successors in estate shall nor erect or construct,or permit to be erected or constructed,any building or other structure,plant any tree or trees,or drill any well or wells,within the limits of said right of way. Grantee shall have the right to erect,maintain and use gates in all fences which now cross or shall hereafter cross said route or routes,and to trim and cut and clear away any trees and brush whenever in its judgment the same shall be necessary for the con- venient and safe exercise of the rights hereby granted,the right to transfer and assign this easement in whole or in part being here- by granted to the Grantee. Grantor agrees that no other easement or easements shall he granted on,under or over said strip of land by Grantor,without the previous written consent of Grantee.
