RESOLUTION NO. 04-018
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
TO ESTABLISH A NINETY-MINUTE PARKING
ZONE IN OLD POWAY PARK
WHEREAS, California Vehicle Code Section 21113 allows cities to post special
parking restrictions on publicly owned property; and
WHEREAS, California Vehicle Code Section 22651 (n) allows any peace officer or
City employee who is engaged in directing traffic or enforcing parking laws and regulations
to remove a vehicle that is parked or left standing where local authorities, by resolution or
ordinance, have prohibited parking and have authorized the removal of vehicles, if signs
are posted giving notice of the removal; and
WHEREAS, this Council has determined that a time-limited parking zone should be
created adjacent to the Hamburger Factory restaurant in Old Poway Park.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1. Parking for longer than 90 minutes is prohibited in the 38 parking spaces
immediately adjoining the Hamburger Factory restaurant in Old Poway Park.
Section 2. This prohibition shall take effect once said property is posted with signs
indicating the 90-minute parking restriction.
Section 3. Vehicles parking for more than 90 minutes on appropriately signed
property may be cited or removed by the Chief of Police or any member of the California
Highway Patrol.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
at a regular meeting this 23rd day of March, 2004.
