CC 2004 02-03 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING FEBRUARY 3, 2004 The February 3, 2004, Regular Meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna, at the Poway Community Library - Meeting Room, 13137 Poway Road, Poway, California. PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedure for Public Oral Communications. The following people were present wishing to speak: Louis Tooch, 14105 Powers Road, expressed his views on Proposition E and the Impartial Analysis. Allen Sterger, 16077 Eucalyptus, expressed his views on the need for a left turn lane at Poway Road and Mina del Oro. Anna Pinto, 14241 York Avenue, expressed her views in opposition to a proposed softball complex in Old Poway Park. 8031 Page 2 - CITY OF POWAY - February 3,2004 CONSENT CALENDAR Mayor Cafagna stated that a request had been received from a member of the public to pull Item 10.1 for discussion. Motion by Councilmember Goldby, seconded by Councilmember Rexford, to approve the remainder of the Consent Calendar as follows: 3. Ratification of Warrant Registers for the period January 5-9, 2004. (0475-20) 4. Approval of Minutes - City Council January 13, 2004 - Regular Meeting 6. Approval of a Community Contribution of $500 for the Poway Mustangs Baseball Academy. (0160-10) 7. Approval of Appropriation of $2,300 from the Unappropriated General Fund for Acquisition of a 1.3-acre Tax Defaulted Parcel, APN: 321-230-74. (0780-08) 8. Approval of Agreement between the City of Poway and Fuse New Media for Development of Two Videos for the Poway Historical and Memorial Society and a Third Video for the City of Poway, if Requested, and Authorization to Expend up to $10,000. (0700-10) 9. Approval of Temporary Sewer Connection for Lakeview Road, APN: 278-170- 80, Sophia Dakis, Applicant. (0940-40) 10. Approval of Temporary Sewer Connection for 16110 Lakeview Road, APN: 278-170-77, Tharwat Issa, Applicant. (0940-40) 10.2 Report of Expenditures from January 27, 2004 to February 2, 2004, pertaining to the Cedar Fire, made under authority of Resolution No. 03-084, adopted on October 28, 2003. (0320-30) Motion carried unanimously. ITEM 1 (0780-08) ENVIRONMENTAL ASSESSMENT 03-13 PURCHASE OF 40-ACRES APN: 314-031-03 TWIN PEAKS MOUNTAIN SOUTHWEST OF DEL POINTE ROAD Mayor Cafagna opened the public hearing and stated that he would disqualify himself from participation as his home is within 500 feet of the property proposed to be acquired. Staff report by City Manager Bowersox. The City was approached by a representative of the Foreman Family Trust, owner of a 40-acre parcel located on Twin Peaks Mountain, southwest of Del Poniente Road, offering the property for sale. This parcel is consistent with previous direction from the City Council to acquire property to preserve prominent landforms in their natural state. An appraisal confirmed a purchase price of $585,000 for this parcel. 8032 Page 3 - CITY OF POWAY - February 3,2004 The following person was present wishing to speak: Dee Fleischman, 14428 Midland Road, spoke in support of the acquisition and inquired as to the location and availability of additional funding for purchase of other sensitive lands. Motion by Councilmember Emery, seconded by Councilmember Rexford, to close the public hearing, approve the Negative Declaration and adopt Planning Resolution No. P-04-10, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Environmental Assessment 03-13 Acquisition of Property on Twin Peaks Mountain Southwest of Del Poniente Road Assessor's Parcel Number 314-031-03." Motion carried 4-0 with Mayor Cafagna disqualified. ITEM 2 (0220-40) PRE-GENERAL PLAN AMENDMENT 03-01 REDESIGNATION OF LAND USE NORTHEAST TERMINUS OF VIA SOMBRAS Mayor Cafagna opened the public hearing. Introduction by City Manager Bowersox. This is a request to redesignate the land use and zoning of one parcel consisting of a 0.98-acre site located at the northeast terminus of Via Sombras from RS-7 to CO. APN: 275-460-55. The following person was present wishing to speak: William Moore, 12762 Via Sombras, applicant, responded to questions of the Council. Council heard the proposal. ITEM 10.1 (0740-55) PENDING LEGISLATION SB 1132 AB 488 Approval of Position on Pending Legislation: Support SB 1132 - Water Security, Clean Drinking Water, Coastal and Beach Protection Act of 2002: Flood Control and Water Management Projects; and AB 488 - Sex Offenders: Access to Registration Information. Mayor Cafagna stated this item had been pulled from the Consent Calendar by Louis Tooch. Louis Tooch, 14105 Powers Road, inquired as to whether the funds from SB 1132 could be used to provide water to revegetate the fire damaged areas. Motion by Councilmember Goldby, seconded by Deputy Mayor Higginson, to approve the positions. Motion carried unanimously. 8033 Page 4 - CITY OF POWAY - February 3,2004 11. City Manager Bowersox did not provide Council with a State Budget Update. (0150-50) MAYOR AND CITY COUNCll.INITIATED ITEMS 15. Council member Goldby requested an update report from Redevelopment Services on his request to pursue a facility for Poway such as a "Java Joes." 17A. Mayor Cafagna did not provide Council with a brief Regional Governance update. (0150-20) Mayor Cafagna requested and received Council concurrence to request staff study and bring a report back on modifying the HCP to increase where necessary, the two acre clearance around homes, in such a way as to not get carried away with removal of habitat. ADJOURNMENT Mayor Cafagna adjourned the meeting at 7:56 p.m. upon motion by Councilmember Emery, seconded by Council member Rexford, in memory of Commander Lloyd Bucher, Captain of the USS Pueblo.
