("OWNER" hereinafter), is the owner of real property commonly known as 14004 Kirkham Way ("PROPERTY" hereinafter) and more fully described as Parcel 4 of Parcel Map 18491, in the City of Poway, County of San Diego, State of California, filed in the Office of the County Recorder of San Diego County June 14, 2000. WHEREAS, OWNER has requested a waiver for the DR 16-010 condition of approvauo loop the water system from the dead-end main, around the building addition being completed under Building Permit B16-2061, to the existing water main along the east side of the building. The waiver is hereby approved, and OWNER agrees that potable water service cannot be added to the dead-end water main servicing the existing fire hydrant along the north side of the building. OWNER further agrees to loop the water system around the building addition by means of an approved Improvement Plan through the City of Poway ("CITY" hereinafter) and provide a minimum 20' wide water easement for said improvements in order to obtain an additional potable water service connection in that location. This Covenant shall run with the land and be binding upon and inure to the benefit of future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties. In the event that the water main loop is constructed, at the request of the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY. If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party.
