Res P-04-23 RESOLUTION NO. P-04-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 04-12 TO HOLD THE ANNUAL POWAY SPRING FEST STREET FAIR WHEREAS, Temporary Use Permit 04-12; Poway Chamber of Commerce, Applicant, requests approval to hold the Annual Poway Spring Fest Street Fair along Midland Road, between Poway Road and Hilleary Place, on Sunday, April 25, 2004, from 10:00 a.m. to 4:00 p.m.; and WHEREAS, on March 30, 2004, the City Council considered the above- referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows: Section 1: The City Council finds that Temporary Use Permit 04-12 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no effects on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 04-12, the Annual Poway Spring Fest Street Fair along Midland Road, between Poway Road and Hilleary Place, on Sunday, April 25, 2004, from 10:00 a.m. to 4:00 p.m., subject to the following conditions: A. The event and related off-site parking shall be conducted as shown on the site plan and application on file in the Development Services Department. B. This permit is valid during the hours of 10:00 a.m. to 4:00 p.m. on Sunday, April 25, 2004, after which time the site shall be restored to its original condition. C. The barricades at the corner of Poway Road and Midland Road and Hilleary Place and Midland Road can be placed at 5:00 a.m. and shall be removed by 7:00 p.m. on Sunday, April 25, 2004. D. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. The site shall be developed in accordance with the approved site plan on file in the Development Services Department, Planning Division, except as otherwise provided herein. F. Prior to the event, the applicant shall comply with the following: 1. The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Community Services, Customer Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Sheriff's Department. 2. Written permission from the property owners who will allow parking for the event is required to be on file in the Development Services Department, Planning Division. 3. Provide the City an insurance policy naming the City of Poway as additionally insured in the amount of $1 million dollars. 4. A copy of a signed Waiver of Liability is to be on file with the Development - Services Department, Planning Division, covering the event, participants and City equipment used during the event. 5. Signs shall be posted on Midland Road giving the particulars of the date and times of closure one week prior to the event. All signage shall be in conformance with the temporary signage provisions of the Poway Municipal Code. Contact the Development Services Department, Planning Division, regarding the Temporary Sign Ordinance prior to the installation of any sign. 6. Vendor's licenses shall be obtained from the City of Poway Customer Services Department for all temporary sales locations. 7. Notify, in writing, Midland Road businesses, the U.S. Post Office, the Silver Oaks Apartment property manager, and residents affected by the road closure. The notices shall be mailed or hand delivered. The notice shall include the details of the date and time of the event, and the area of the road to be closed. 8. The applicant shall have individuals designated at all times, and at specific locations, to provide liaison with representatives of the City's Safety Services and Sheriff's Departments. 9. An alternative City bus route/stop plan for Midland Road shall be provided and approved by the Community Services Department prior to the event. Resolution No. P-Q4- 23 Page 3 G. During the event, the applicant shall comply with following: 1. Prior to and during the event, emergency vehicle access to any street, fire lane, building, fire hydrant, or fire sprinkler system connection shall not be blocked. 2. Maintain emergency vehicle access along the entire stretch of Midland Road. 3. Provide a fire extinguisher with a minimum rating of 2A10BC at any booth where cooking is done. 4. All compressed gas cylinders must be secured from falling over. 5. A permit for any canopy that exceeds 400 square feet shall be obtained from the Fire Department. H. At the conclusion of the event, the applicant shall comply with the following: 1. Public streets, off-street parking sites, and areas within and adjoining the proposed area for the event shall be cleared of debris, litter, temporary signs and all other evidence of the event. Section 4: This approval shall become null and void on Sunday, April 25, 2004, at 7:00 p.m., at which time the site utilized shall have been restored to its original condition.
