A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
UPDATING EDCO WASTE AND RECYCLING SERVICES' RATE SCHEDULE BY
ADDING A DAILY IMPOUND FEE FOR THE STORAGE OF UNAUTHORIZED
CONTAINERS, AND RESCINDING RESOLUTION NO. 03 -048
WHEREAS, the Public Resources Code Sections 49901 provides local jurisdictions
the authority to assess solid waste fees to meet state - mandated costs associated with the
passage of AB939; and
WHEREAS, the City Council awarded the exclusive Solid Waste Franchise
Agreement to Mashburn Waste and Recycling Services (Franchisee) on September 21,
1994; and Mashburn became EDCO Waste and Recycling Services, Inc. in 1998; and
WHEREAS, the City Council adopted Resolution No. 03 -048 on June 10, 2003,
approving an adjustment to EDCO Waste and Recycling Services' Rate Schedule, effective
July 1, 2003;
WHEREAS, it is in the public interest to protect the exclusivity of the franchise
agreement in order to comply with the California Integrated Waste Management Act of
1989 by authorizing the Franchisee to remove any container placed within the boundaries
of the City in violation of Section 8.68.330 of the Poway Municipal Code, dispose of the
contents thereof, and store the container at Franchisee's place of business.
WHEREAS, Section 8.68.330 of the Poway Municipal Code further authorizes the
Franchisee to bill the owner of the container for transportation and disposal costs, and daily
impound fees, as prescribed in the rate schedule established from time to time by
resolution of the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1 . Resolution 03 -048 is hereby rescinded.
Section 2 . The following fee is hereby established for the daily storage of
unauthorized containers impounded by the Franchisee:
Daily Impound Fee for Storage of Unauthorized Containers: $20.00
Section 3. The fee shall be included in the attached "Schedule of Maximum
Rates to be Charged and Collected for Collection Services of Garbage or Rubbish in the
City of Poway ", effective March 1, 2004, hereby adopted as shown in Exhibit A.
