RESOLUTION NO. P-04- 28
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 04-15
TO HOLD THE ANNUAL EARTH/ARBOR DAY CELEBRATION
WHEREAS, Temporary Use Permit 04-15; City of Poway Community Services,
Applicant, requests approval to hold the Annual Earth/Arbor Day Celebration at Old
Poway Park, 14134 Midland Road, on Saturday, April 24, 2004, from 9:00 a.m. to 2:00
p.m.; and
WHEREAS, on April 20, 2004, the City Council considered the above-referenced
item.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, as follows:
Section 1: The City Council finds that Temporary Use Permit 04-15 is Categorically
Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to
Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will
have no effects on the environment.
Section 2: The proposed use is in accordance with the purposes and standards of
Section 17.26.030.A of the Poway Municipal Code.
Section 3: The City Council hereby approves Temporary Use Permit 04-15, the Annual
Earth/Arbor Day Celebration at Old Poway Park, 14134 Midland Road, on Saturday,
April 24, 2004, from 9:00 a.m. to 2:00 p.m., subject to the following conditions:
A. The event and related off-site parking shall be conducted as shown on the site
plan and application on file in the Development Services Department.
B. This permit is valid during the hours of 9:00 a.m. to 2:00 p.m. on Saturday, April
24, 2004, after which time the site shall be restored to its original condition.
C. Approval of this activity shall not excuse compliance with all other sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.
D. The site shall be developed in accordance with the approved site plan on file in
the Development Services Department, Planning Division, except as otherwise
provided herein.
E. Prior to the event, the applicant shall comply with the following:

1. The following City of Poway departments shall be contacted for
appropriate permits, coordination, and inspections: Public Works,
Community Services, Customer Services, Development Services
(including the Building, Traffic Engineering, and Planning Divisions),
Safety Services, and the Sheriff's Department.
2. Obtain a permit from the Fire Department for any canopy that exceeds
400 square feet.
3. All proposed signs shall be approved by the Development Services
Department, Planning Division, and shall be in accordance with Section
17.40 of the Poway Municipal Code.
F. During the event, the applicant shall comply with following:
1. Do not block emergency vehicle access to any street, building, fire hydrant
or fire sprinkler connection.
2. Provide a fire extinguisher with a minimum rating of 2A 1 OBC at any booth
where cooking is done.
3. All compressed gas cylinders must be secured from falling over.
G. At the conclusion of the event, the applicant shall comply with the following:
1. Public streets, off-street parking sites, and areas within and adjoining the
proposed area for the event shall be cleared of debris, litter, temporary
signs and all other evidence of the event.
Section 4: This approval shall become null and void on Saturday, April 24, 2004, at
3:00 p.m., at which time the site utilized shall have been restored to its original
condition.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 20th day of April 2004.
