Res P-04-43 RESOLUTION NO. P-O4-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 04-32 TO HOLD THE ANNUAL OLD FASHIONED FOURTH OF JULY 2004 AND THE FIREWORKS DISPLAY WHEREAS, Temporary Use Permit 04-32, City of Poway Community Services Department, Applicant, requests approval to hold the annual Old Fashioned Fourth of July 2004 at Old Poway Park, located at 14134 Midland Road, from 10:00 a.m. to 4:00 p.m., and the Fireworks Display at Poway High School, located at 15500 Espola Road, from 9:00 p.m. to 9:20 p.m., on Sunday, July 4, 2004. WHEREAS, on June 29, 2004, the City Council considered the above-referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows: Section 1: The City Council finds that Temporary Use Permit 04-32 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304( e) of the CEQA Guidelines, as the events are temporary in nature and will have no effects on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 04-32, the annual Old Fashioned Fourth of July 2004 at Old Poway Park, located at 14134 Midland Road, from 10:00 a.m. to 4:00 p.m., and the Fireworks Display at Poway High School, located at 15500 Espola Road, from 9:00 p.m. to 9:20 p.m., on Sunday, July 4,2004, subject to the following conditions: A. The events and related off-site parking shall be conducted as shown on the site plan and application on file in the Development Services Department. B. The permit is not valid until the applicant provides authorization from the Poway Unified School District for the use of the Poway High School field. C. This permit is valid for Old Poway Park during the hours of 7:00 a.m. to 5:00 p.m. and at Poway High School during the hours of 5:00 p.m. to 10:00 p.m. on Sunday, July 4, 2004, after which time the sites shall be restored to their original condition. D. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. The sites shall be developed in accordance with the approved site plans on file in the Development Services Department, Planning Division, except as otherwise provided herein. F. Prior to the events, unless other timing is indicated, the applicant shall comply with the following: 1. The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Community Services, Customer Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Sheriffs Department. 2. Any requests for Public Works support shall be made at least two weeks prior to the scheduled events. 3. All proposed signs shall be approved by the Development Services Department, Planning Division, and shall be in accordance with Section 17.40 of the Poway Municipal Code. G. The applicant shall comply with the following to the satisfaction of the Fire Marshal: 1. Prior to and during the events, emergency vehicle access to any street, building, fire hydrant, fire sprinkler system connection, parking lot, the football field, or the Fireworks Display shall not be blocked. 2. Obtain a permit from the Fire Department for any canopy that exceeds 400 square feet and any tent that exceeds 200 square feet. 3. The fireworks company is to obtain a permit from the Fire Department for the Fireworks Display. 4. Provide a fire extinguisher with a minimum rating of 2A:10BC at booths where food preparation is done. 5. Secure any compressed gas cylinders from falling over. 6. Parking at all fire lanes is prohibited. H. At the conclusion of the events, the applicant shall comply with the following: 1. Public streets, off-street parking sites, and areas within and adjoining the proposed area for the events shall be cleared of debris, litter, temporary signs, and all other evidence of the events. Resolution No. P-04- 43 Page 3 Section 4: This approval shall become null and void on Sunday, July 4, 2004, at 10:00 p.m., at which time the sites utilized shall have been restored to their original condition.
