Grant of Right of Way 1960-150076 GRANT OF RIGHT OF WAY
POMERADO CEMETERY DISTRICT
, as Grantor, for and in consideration of the sum of One Dollar and
other valuable consideration paid by POWAY MUNICIPAL WATER DISTRICT
as Grantee, receipt whereof is hereby acknowledged, do hereby grant to said
POWAY MUNICIPAL WATER DISTRICT
its successors and assigns, an easement of right of way 19 feet in width in, upon, over, under, and across the
lands hereinafter described, to erect, construct, reconstruct, replace, repair, maintain and use a pipeline or pipelines for
any and all purposes, together with their necessary fixtures and appurtenances including but not limited to conduits and
cables for power transmission and communication purposes, at such locations and elevations, upon, along, over and under
the hereinafter described right of way as Grantee may now or hereafter deem convenient and necessary from time to time,
together with the right of ingress thereto and egress therefrom, to and along said right of way by a practical route or routes
in, upon, over and across the hereinafter described lands, together with the right to clear and keep clear said right of way
from explosives, buildings and structures.
The lands in which said easement of right of way is hereby granted are situated in the County of San Diego
State of California, and are particularly described as follows, to wit:
"Lot 2, Section 7, Township 14 South, Range 1 West, San Bernardino
Base & Meridian, in the County of San Diego, State of California, ac-
cording to United States Government Survey. "
The westerly line of said easement of right of way is the westerly
line of the following described parcel of real property:
"That portion of Lot 2, Section 7, Township 14 South, Range 1 West,
San Bernardino Base & Meridian, in the County of San Diego, State of
California, according to United States Government Survey which lies
within a parcel of land described as follows:
"Beginning at the Northeast corner of said Lot 2, being the True
Point of Beginning: thence along the East Line of said Lot 2 South
0040 ' 40"Eto the Southwest corner of Dearborn Cemetery according to the
Map of said cemetery No. 831, filed in the office of the County Re-
corder of San Diego County, April 22, 1897; thence along the South
line of said Dearborn Cemetery South 88°24' 29 " East 305.84 feet;
thence South 0°18 ' 33 " West 23. 16 feet; thence North 87°35 ' 35" West
329. 34 feet; thence North 0°18133" East to the North line of said
Lot 2; thence East along said North line to the True Point of Beginning".

In the event Grantee, in the use of the easement herein granted,
damages any improvements located on the property owned by Grantor,
whether the same be now in existence or be hereafter installed, Grantee
covenants and agrees to forthwith, at its own expense cause the same
to be repaired or replaced.
Grantee covenants and agrees that it will make no use of the
premises herein conveyed that will have the effect of permanently
limiting or restricting the usage by Grantor of said conveyed
premises for roadway purposes.

Grantor agrees that no other easement or easements shall be granted on, under or over said strip of land by Grantor.

increase or decrease, or permit to be increased or decreased. the existing ground elevations of the above described right
of way, existing at the time this document is executed, without the previous 1%ritten consent of the Grantee.
