other valuable consideration paid by POWAY MUNICIPAL WATER DISTRICT, a municipal water district,
organized and existing under the Municipal Water District Act of 1911, as amended.
as Grantee, receipt whereof is hereby acknowledged. do hereby grant to said POWAY MUNICIPAL WATER
DISTRICT
its successors and assigns, an easement of right of way 10.00 feet in width in, upon, over, under, and across the
lands hereinafter described, to erect, construct, reconstruct, replace, repair, maintain and use a pipeline or pipelines for
any and all purposes, together with their necessary fixtures and appurtenances including but not limited to conduits and
cables for power transmission and communication purposes, at such locations and elevations, upon, along, over and under
the hereinafter described right of way as Grantee may now or hereafter deem convenient and necessary from time to time,

from explosives, buildings and structures.
The lands in which said casement of right of way is hereby granted arc situated in the County of San Diego ,
State of California, and are particularly described as follows, to wit:
Those portions of Sections 30 and 31, Township 13 South, Range 1 West,
San Bernardino Base and Meridian, in the County of San Diego, State of California,
according to United States Government Survey approved September 21, 1875, des-
cribed as follows:
Beginning at the South Quarter corner of said Section 30; thence North
0°11128" West along the North and South center line of said Section 30, a distance
of 1665.65 feet; thence South 87°08130" West 494.73 feet to the true point of
beginning; thence North 51°171 West 371. 37 feet; thence North 44°58120" West 654.67
feet; thence South 41°16120" West 209.13 feet; thence North 48°25140" West 341.37
feet; thence North 60°23110" West 194.86 feet; thence South 19°10120" West 796.84
feet; thence South 23°35'20" East 1900.15 feet, more or less, to the Southeast cor-
ner of the Southwest Quarter of the Southwest Quarter of said Section 30, being an
angle point in the Northerly boundary of land described in deed to Howard G. Smits
(Trustee) recorded May 4, 1956 in Book 6088, page 220 of Official Records; thence
along the boundary of said Smits land as follows:
South 24°39130" East 500.41 feet; more or less, to an angle point therein,
South 58°14110" East, 156.31 feet; thence South 86°57130" East 332.06 feet; South
8°031 East 334.42 feet; North 84°151 East 624.95 feet to a point on the center
line of the County Road known as Road Survey No. 335, as described in deed to the
County of San Diego, recorded August 12, 1937 as Document No. 47167, in Book 669,
page 484 of Official Records; thence Northerly along said center line to a line
which bears North 87°08130" East from the true point of beginning; ter South
87°08130" West to the true point of beginning. .

dated October 16, 1948, in Case No. 675, San Diego Civil in the District Court
of the United States, Southern District of California, Southern Division.

EXCEPTING THEREFROM all that portion thereof not included within the

Grantor and t successors in estate shall not erect or construct, or permit to be erected or constructed, any
building or other structure, plant any tree or trees, or drill any well or wells, within the limits of said right of way.
Grantee shall have the right to erect, maintain and use gates in all fences which now cross or shall hereafter cross
said route or routes, and to trim and cut and clear away any trees and brush whenever in its judgment the same shall he
necessary for the convenient and safe exercise of the rights herrhy granted, the right to transfer and assign this easement
in whole or in part being hereby granted to the Grantee.

State of California, and are particularly described as follows, to wit:
That portion of Section 30, Township 13, South, Range 1 West, San Bernardino
Base and Meridian, in the County of San Diego, State of California, according to
United States Government Survey approved September 21, 1875, described as follows:
Beginning at a point in the North and South center line of said Section 30,
which is distant thereon North 0°11128" West 342.39 feet from the center of said
Section 30, being the Northeasterly corner of an easement and right of way for road
purposes, as reserved by Ray H. WHITTEN and Bernice A. WHITTEN, husband and wife,
by deed recorded April 20, 1956 under Recorder's File No. 54748 in Book 6068, page
500 of Official Records, said point of beginning being designated Point "A" of this
description; thence along said North and South center line of Section 30, South
0°11128" East 1392.20 feet to an angle point in the boundary of that parcel of land
described in deed to Pacific Iron and Steel Company recorded April 20, 1956 as Do-
cument No. 54748 in Book 6068, page 500 of Official Records; thence along said
boundary, South 87°08130" West to the Southwesterly line of a right of way for an
aqueduct to be known as the San Diego Aqueduct over a portion of Sections 30 and
31, herein described, as said aqueduct is described in Case No, 675, San Diego Civil
in the District Court of the United States, Southern District of California, Southern
Division, a notice of Pendency of said Action being recorded November 21, 1945 ir. Book
1986, page 1 of Official Records; being the TRUE POINT OF BEGINNING; thence Northwest-
erly along said Southwesterly line to the Southeasterly line of the land shown as
Parcel 6o on Record of Survey Map No. 4253, filed in the Office of the Ce1.1iy Record-
er of said County; thence along said Southeasterly line and the prolongation thereof,
North 49°14130" East to the Westerly prolongation of the Northerly line of said ease-
ment reserved by Whitten in deed recorded in Book 6068, page 500 of Official Records,
being a line which bears North 88°32140" West from said Point "A"; thence Couth-8€°
32140" East to a point on the center line of the County Road known as Road Survey
