GRANT OF RIGHT OF WAY
GILBERT C. and HELEN MILLER, husband and wife, as Grantor, for and in consid-
eration of the sum of One Dollar and other valuable consideration paid by POWAY
MUNICIPAL WATER DISTRICT, a municipal water district, organized and existing under
the Municipal Water District Act of 1911, as amended, as Grantee, receipt whereof
is hereby acknowledged, do hereby grant to said POWAY MUNICIPAL WATER DISTRICT its
successors and assigns, an easement of right of way 10.00 feet in width in, upon,
over, under and across the lands hereinafter described, to erect, construct, recon-

struct, replace, repair, maintain and use a/pipeline for any-and-aii purposes,
together with its necessary fixtures and appurtenances, together with the right
of ingress thereto and egress therefrom, to and along said right of way by a practi-
cal route or routes in, upon, over and across the hereinafter described lands.
The lands in which said easement of right of way is hereby granted are situa-
ted in the County of San Diego, State of California, and are particularly described
as follows, to wit:
PARCEL 1:
All that portion of the Southeast Quarter of the Southeast Quarter of
Section 32, Township 13 South, Range 1 West, San Bernardino Meridian,
in the County of San Diego, State of California, according to United
States Government Survey approved November 19, 1880, described as
follows:
Beginning at a point in the West line of said Southeast Quarter of the
Southeast Quarter distant thereon South 02°04'51" West, 357.00 feet
from the Northwest corner of said Southeast Quarter of the Southeast
Quarter, being the Southeast corner of that parcel of land described
in deed to Ross J. Garofalo, et ux, recorded June 6, 1955, in Book
5668, page 289 of Official Records. Said point being also the true
point of beginning; thence leaving said West line of the Southeast Quar-
ter of the Southeast Quarter, South 31°34'22" East, 173.94 feet to a
point herein designated as Point "A", thence South 23°19'20" East,
237.78 feet; thence South 12°21'40" West, 114.45 feet; thence South
01°41'50" West, 184.75 feet; thence South 18°27'20" East, 90.59 feet;
thence South 21°47'20" West, 129.99 feet; thence South 10°42'40" West,
113.04 feet, more or less, to a point in the South line of said South-
east Quarter of Southeast Quarter, distant thereon North 89°47140" East,
161.47 feet from the Southwest corner of said Southeast Quarter of the
Southeast Quarter of Section 32; thence along said South line of said
Southeast Quarter of Southeast Quarter, South 89°47'40" West, 161.47
feet to said Southwest corner of said Southeast Quarter of the South-
east Quarter of Section 32; thence along the West line of said South-
east Quarter of the Southeast Quarter of Section 32, North 02°04151"
East, 681.64 feet to the Easterly terminus of the center line of that
40 foot easement for road purposes described in Parcel 2 in deed to
John A. Sparkman recorded July 17, 1956, in Book 6180, page 30 of
Official Records, said point being herein designated as Point "B";
thence continuing along said West line, North 02°04'51" East, 300.46

All that portion of the Southwest Quarter of the Southeast Quarter of
Section 32, Township 13 South, Range 1 West, San Bernardino Meridian,
in the County of San Diego, State of California, according to United
States Government Survey, approved November 19, 1880, described as
follows:
Beginning at a point in the East line of said Southwest Quarter of the
Southeast Quarter of Section 32, distant thereon South 02°04'51" West,
357.00 feet from the Northeast corner of said Southwest Quarter of the
Southeast Quarter, being the Southeast corner of that parcel of land
described in deed to Ross J. Garofalo, et ux, recorded June 6, 1955,
in Book 5668, Page 289 of Official Recirds, said point being also the
true point of beginning; thence continuing along the East line of said
Southwest Quarter of the Southeast Quarter, South 02°04'51" West, 982.10
feet to the Southeast corner of said Southwest Quarter of the Southeast
Quarter; thence along the South line of said Southwest Quarter of the
Southeast Quarter, South 89°47'40" West, 687.40 feet, more or less, to
a point thereon that is 303.40 feet Easterly therealong from the South-
east corner of that parcel of land described in deed to Walter Earl
Hirtenstiner, et ux, recorded March 22, 1956 in Book 6027, Page 283 of
Official Records, said point being herein designated as Point "A";
thence North 00°11' West, 927.85 feet, more or less, to the Southerly
line of that 40 foot easement for road purposes described in Parcel 2
in deed to John A. Sparkman, recorded July 17, 1956 in Book 6180, Page 30
of Official Records, said point being herein designated as Point "B";
thence along the Southerly line of said 40 foot road easement North 89°
42'57" West, 303.40 feet, more or less, to the Easterly line of said
Hirtenstiner land; thence along the Easterly line of said Hirtenstiner
land, North 00°11' West to an angle point in the boundary of said Garo-
falo land; thence along the Southerly line of said Garofalo land, South
89°42'57" East, 1029.65 feet to the true point of beginning.
The center line of said easement of right of way in the aforesaid lands is particu-
larly described as follows:
Beginning at the Southeast Corner of Section 32, Township 13 South,
Range 1 West as said Corner is shown on Record of Survey Map No. 6023,
filed in the Office of the Recorder of San Diego County on March 21,
1962; thence North O1°37'35" East along the East line of said Section
32, 577.50 feet to the TRUE POINT OF BEGINNING: thence North 88°47'05"
West 218.40 feet; thence South 87°51'35" West 109.60 feet; thence South
89°07'35" West 237.02 feet; thence South 44°26'05" West 30.92 feet;
thence South 89°26'05" West 374.66 feet; thence North 36°32'08" West
61.77 feet; thence North 82°11'05" West 15.40 feet to the beginning of
a 400 foot radius tangent curve concave Southerly; thence Westerly
along said curve through a central angle of 24°23'10", an arc distance
of 170.23 feet; thence South 73°25145" West 96.63 feet to the beginning
of a 300 foot radius tangent curve concave Northerly; thence Westerly
along said curve through a central angle of 11°41'00", an arc distance
of 61. 17 feet; thence South 85°06'45" West 97.80 feet; thence North 68°
05'55" West 29. 15 feet to the beginning of a 200 foot radius tangent
curve concave Southerly; thence Westerly along said curve through a
central angle of 15°00'00", an arc distance of 52.36 feet; thence North
83°05'55" West 92.98 feet to the beginning of a 300 foot radius tangent
curve concave Northerly; thence Westerly along said curve through a
central angle of 17°28'40", an arc distance of 91.51 feet; thence North
65°37'15" West 129.16 feet; thence North 89°43'30" West 262.80 feet.
EXCEPTING THEREFROM all that portion thereof not included within the lands first
above described.

Grantee agrees to repair such existing irrigation pipelines or replacements
thereof which now lie within the herein described easement and which may be damaged
by the Grantee.
Grantee in the use of the rights herein granted agrees to exercise reasonable care
to cause the least interruption of service provided by the existing irrigation pipelines.
Grantee agrees to exercise reasonable care to prevent damage to trees which over-
hang the herein described easement.
