Grant of Right of Way 1964-76480 GRANT OF RIGHT OF WAY H,B, FRY and BETH N. FRY, husband and wife, as joint tenants , as Grantor, for and in consideration of the sum of One Dollar and other valuable consideration paid by .POWAX MUNICIPAL WATER DISTRICT, a municipal water district, organized and_.existing under. the_.Mvnicipal._Watier. District Act of 1911, as amended, as Grantee, receipt whereof is hereby acknowledged, do hereby grant to said POWAXWJNICIPAL WATER DISTRICT its successors and assigns, an easement of right of way 10.00 feet in width in, upon, over, under, and across the lands hereinafter described, to erect, construct, reconstruct, replace, repair, maintain and use a pipeline or pipelines for any and all purposes, together with their necessary fixtures and appurtenances •• • . •. •: ., at such locations and elevations, upon, along, over and under the hereinafter described right of way as Grantee may now or hereafter deem convenient and necessary from time to time, together with the right of ingress thereto and egress therefrom, to and along said right of way by a practical route or routes in, upon, over and across the hereinafter described lands, together with the right to clear and keep clear said right of way from explosives, buildings and structures. The lands in which said easement of right of way is hereby granted are situated in the County of San Diego State of California, and are particularly described as follows, to wit: That portion of the Southeast Quarter of the Southeast Quarter of Section 32, Town- ship 13 South, Range 1 West, San Bernardino Meridian, in the County of San Diego, State of California, according to United States Government Survey approved November 19, 1880, described as follows: Beginning at a point on the South line of said Section 32, distant thereon South 89° 47'40" West, 523.46 feet from the Southeast corner thereof; thence North 26°44'20" West, 37.80 feet; thence North 64°23'20" East, 190.88 feet; thence North 32°06'10" East, 106.37 feet; thence North 48°19'30" East, 91.51 feet; thence North 59°11'50" East, 115.55 feet; thence North 82°19'10" West, 210.05 feet; thence South 31°01'40" West, 174.41 feet; thence South 84°41'50" West, 230.51 feet; thence North 0°21' West, 425.35 feet to an intersection with a line which bears South 89°41'30" East from an angle point in the Easterly boundary of land described under Parcel 1 in deed to Gilbert C. Miller, et ux, recorded February 4, 1957 in Book 6442, page 502 of Official Records, said angle point being formed by the courses described in said deed as "South 23°19'20" East, 237.78 feet" and "South 12°21'40" West, 114.45 feet"; thence North 89° 41'30" West to said angle point hereinabove referred to; thence along the Easterly boundary of said Miller land, as follows: South 12°21'40" West, 114.45 feet, South 01°41'50" West, 184.75 feet, South 18°27'20" East, 90.59 feet, South 21°47'20" West, 129.99 feet and South 10°42'40" West, 113.04 feet, more or less, to a point in the South line of said Southeast Quarter of the Southeast Quarter, distant thereon North 89°47'40" East, 161.47 feet from the Southwest corner of said Southeast Quarter of the Southeast Quarter of said Section 32; thence along said South line, North 89°47' 40" East, to the point of beginning. 411 411 The center line of said easement •ght of way in the aforesaid lands is partly described as follows: Beginning at the Southeast Corner of Section 32, Township 13 South, Range 1 West as said Corner is shown on Record of Survey Map No. 6023, filed in the Office of the Recorder of San Diego County on March 21, 1962; thence North O1°37' 35" East along the East line of said Section 32, 577.50 feet to the TRUE POINT OF BEGINNING; thence North 88°47'05" West 218.40 feet; thence South 87°51'35" West 109.60 feet ; thence South 89°07' 35" West 237.02 feet ; thence South 44°26 '05" West 30.92 feet ; thence South 89°26'05" West 374.66 feet; thence North 36°32'08" West 61. 77 feet ; thence North 82°11'05" West 15.40 feet to the beginning of a 400 foot radius tangent curve concave Southerly; thence Westerly along said curve through a central angle of 24° 23' 10", an arc distance of 170.23 feet; thence South 73°25'45" West 96.63 feet to the beginning of a 300 foot radius tangent curve concave Northerly; thence Westerly along said curve through a central angle of 11°41'00", an arc distance of 61. 17 feet ; thence South 85°06'45" West 97.80 feet; thence North 68°05 '55" West 29.15 feet to the beginning of a 200 foot radius tangent curve concave Southerly; thence Westerly along said curve through a central angle of 15°00'00", an arc distance of 52.36 feet; thence North 83°05 '55" West 92.98 feet to the beginning of a 300 foot radius tangent curve concave Northerly; thence Westerly along said curve through a central angle of 17°28' 40", an arc distance of 91.51 feet; thence North 65°37' 15" West 129.16 feet; thence North 89°43'30" West 262.80 feet. Grantee shall have the right to erect, maintain and use gates in all fences which now cross or shall hereafter cross said route or routes, and to trim and cut and clear away any trees and brush whenever in its judgment the same shall he necessary for the convenient and safe exercise of the rights herchy granted, the right to transfer and assign this easement in whole or in part being hereby granted to the Grantee. Grantor agrees that no other easement or easements shall be granted on, under or over said strip of land by Grantor, without the previous written consent of Grantee.
