PARKER, husband and wife , as Grantor, for and in consideration of the sum of One Dollar and other valuable consideration paid by POWAY MUNICIPAL WATER DISTRICT, a public corporation as Grantee,receipt whereof is hereby acknowledged,do hereby grant to said POWAY MUNICIPAL WATER DISTRICT its successors and assigns,an easement of right of way 20,00 feet in width in,upon,over,under,and across the lands hereinafter described,to erect,construct, reconstruct, replace, repair, maintain and use a pipeline or pipelines for any and all purposes,together with their necessary fixtures and appurtenances including but not limited to facilities for power transmission and communication purposes,at such locations and elevations,upon,along,over and under the hereinafter described right of way as Grantee may now or hereafter deem convenient and necessary from time to time,together with the right of ingress thereto and egress therefrom, to and along said right of way by a practical route or routes in,upon,over and across the hereinafter described lands,together with the right to use said right of way for access to Grantee's rights of way situated in adjacent lands. The lands in which said easement of right of way is hereby granted are situated in the County of San Diego State of California,and arc particularly described as follows,to wit: The Northerly 265.00 feet of the Westerly 315.00 feet of the Southeast Quarter of the Southeast Quarter of the Northwest Quarter of Section 18, Township 14 South, Range 1 West, San Bernardino Base and Meridian, in the County of San Diego, State of California, according to United States Government Survey; together with that portion of the Westerly 170.00 feet of said Southeast Quarter of the Southeast Quarter lying Southerly of the Southerly line of the Northerly 265.00 feet of the Westerly 315.00 feet herein described and lying Northerly of the Northerly line of the Southerly 200.00 feet of said Southeast Quarter of the Southeast Quarter. Grantee shall have the right to erect,maintain and use gates in all fences which now cross or shall hereafter cross said route or routes,and to trim and cut and clear away any trees and brush whenever in its judgment the same shall be necessary for the con- venient and safe exercise of the rights hereby granted,the right to transfer and assign this easement in whole or in part being here- by granted to the Grantee. J . PARKER (hereinafter called "Owner") , in view of the following facts: A. District, in connection with its Transmission Mains 1972-1973 pipeline construction project, was required to acquire an easement across Owner' s property and to con- struct its pipeline over Owner ' s land. B. In connection with said easement and construc- tion', Owner and District entered into an agreement of sale for the easement dated March 7 , 1973 . C. As, part of. said agreement, .District requested . • Owner to defer major street surface improvements along District' s Transmission Main ,a'li'gnment''until; Distri'ct',s' pipeline was in- stalled and in consideration therefor the agreement between District and Owner provided certain considerations to Owner. D. Owner has now made a claim. upon District that unforeseen circumstances have arisen which caused him damages beyond those anticipated by Owner. Owner_ has made further claims for. damages in relation to the manner in which the work • wa's performed and the time for completion. • E. The parties have arrived at an agreement, the terms of which are set forth below, wherein . Owner will accept in. complete 'and ' full satisfaction of any and all claims ' Owner might have for damages arising out of or resulting ' • from the construction' and alleged delay, a fire hydrant as • set 'forth below. • , IT IS THEREFORE AGREED as- follows : ' . 1.• . District shall, without cost to Owner, as . . . additional consideration for the execution of the: Agreement - dated March .7, 197:3,, and. for the release of. Owner herein, , . install a fire hydrantadjacent to Owner 's property. on Olive • Tree tane at the shortest distance from the District' s facilities . . • 2 . Owner hereby releases District, its directors , officers , employees,—engineers , and contractor from any and .all claims Owner•`might. ,have,''lab'ilities and demands , known or unknown, . arising out of the installation of the construction ,? . of the Transmission Mains and aany:'delay in the completion • thereof, including;without 'iimitation; damage: to vegetation, • trees , increased costs to Owner in making his improvements . • and a dditionaL.charges• imposed _by government agencies . , . • 3. Owner is aware of Section 1542 of the California , Civil Code which provides that "A general release doesnot extend to claims whichthe creditor does not-.know or suspect • r ' to exist in his favor at the time of executing the release, which, if known' to him, must have materially affected his settle ' • ' pent with the debtor.
