Grant of Right of Way 1973-150553 • Ty• 893 _ ,73 GRANT OF RIGHT OF WAY JUDITH F. ARMSTRONG, a married woman, and L. J. ARMSTRONG , as Grantor, for and in consideration of the sum of One Dollar and other valuable consideration paid by POWAY MUNICIPAL WATER DISTRICT, a public corporation kll fo ' 4) as Grantee,receipt whereof is hereby acknowledged,do hereby grant to said POWAY MUNICIPAL WATER DISTRICT its successors and assigns,an easement of right of way 30.00 feet in width in,upon,over,under,and across the lands hereinafter described, to erect,construct,reconstruct, replace,repair, maintain and use a pipeline or pipelines for any and all purposes,together with their necessary fixtures and appurtenances including but not limited to facilities for power transmission and communication purposes,at such locations and elevations,upon,along,over and under the hereinafter described right of way as Grantee may now or hereafter deem convenient and necessary from time to time,together with the right of ingress thereto and egress therefrom, to and along said right of way by a practical route or routes in,upon,over and across the hereinafter described lands,together with the right to use said right of way for access to Grantee's rights of way situated in adjacent lands. The lands in which said easement of right of way is hereby granted are situated in the County of San Diego State of California,and are particularly described as follows,to wit: That portion of Lot 3 in Section 6, Township 14 South, Range 1 West, San Bernardino Base and Meridian, in the County of San Diego, State of California , according to United States Government Survey approved February 24, 1876, described as follows: Commencing at a point in the Westerly line of said Lot 3, which is distant North 00°46' 41" West 270.99 feet from the Southwest corner of said Lot; thence East 320.00 feet; thence South 00°46'41" East, 5. 53 feet to the Southwesterly corner of land described in deed to Charles A. Kellogg, et ux, recorded September 24, 1959 in book 7899, page 3,91 of Official Records, said point being the TRUE POINT OF BEGINNING; thence continuing South 00'46'41" East 270. 60 feet to the South line of said Lot 3; thence along said South line of said Lot 3 South 89°05'03" East 557. 28 feet more or less to the most Easterly corner of that Parcel of land described in deed to Agnes L. Frame, recorded May 27, 1955, as Document No. 69354, in Book 5659 , page 5 of Official Records; thence along the Northeasterly line of said Frame's land North 38°15'40" West (record North 38°19'09" West) 356. 25 feet to an angle point in the Northeasterly and Easterly boundary thereof said point also being the Southeasterly corner of land described in deed to Charles A. BLOOM, RECORDER NO FEE Pr— aid easement of right of way in the aforesaid lands is particularly described as follows: All that portion of the lands first above described lying within a strip of land4 30.00 feet of even width, the center line of said 30.00 foot wide strip of land being described as follows: Commencing at the Northwesterly corner of said Lot 3; thence along the Northerly line thereof , South 89° 31 ' 41" East 553.26 feet to an intersection with a line drawn parallel with, and distant 20.00 feet Westerly, measured at right angles, from the center line of that certain 20.00 foot wide strip of land described in Deed to the POMERADO COUNTY WATER DISTRICT, filed in the Office of the County Recorder of saidhSan Diego County September 18, 1961 as Document No. 16190J of Official Records, • being the TRUE POINT OF BEGINNING; thence along said parallel line , South 03° •)6' 04" East (record South 3°40'01" East) 227.64 feet, and South 7°04'57" East (record South 07° 38 ' 54" East) 829.95 feet , thence leaving said parallel line, South JO° 08' 16" East 60.06 feet ; thence South 02° 51 ' 49" West 173.35 feet to the beginning of a tangent curve, concave Easterly, having a radius of 3000.00 feet ; thence Southerly along the arc of said curve, through a central angle of 02° 58 ' 05", a distance of 155.41 feet to its point of tangency with the Westerly „tine•of the Easterly 15.00 feet of the West Half of the Southeast Quarter of the Northwest Quarter of Section 6, Township 14 South, Range 1 West San Bernardino Meridian. TOGETHER WITH an easement for a temporary working strip of land , situated within the lands first above described, said easement shall include, but not be limited to, the right and privilege of workmen, contractors, and any and all agents employed by the Grantee herein, to use and occupy said temporary working strip for the purpose of constructing the hereinbefore mentioned pipeline or pipelines, and any and all • appurtenances incidental thereto, and said easement shall include the right and privilege to place and operate any and all machinery on said strip which the Grantee herein, or any agent or contractor employed by said Grantee, deems necessary for the construction of said pipeline or pipelines. Said temporary working strip hereinabove referred to being more particularly described as follows: • A strip of land 40.00 feet of even width situated within the lands first above described, said 40 .00 feet wide strip of land lying Easterly of , and immediately adjoining the 30.00 foot wide strip of land described above. It is hereby understood and agreed upon by the Grantor and Grantee herein, that the right and privilege set forth for the use of the above described temporary working strip shall be in full force and effect from the date of execution of this instrument , and shall continue in full during the construction of said pipeline , and that upon completion, final inspection, and acceptance of the pipeline by said Grantee herein, the easement for the temporary working strip hereby granted and described above, shall cease and terminate , and become of no further force or effect. It is also understood and agreed upon by the Grantor and Grantee herein, that the grant and termination of the easement for the temporary working strip hereinabove described shall in no way affect or frustrate the continued enjoyment and use of the 30.00 foot wide easement first above described . the previous written consent of Uranree. Grantee shall have the right to erect,maintain and use gates in all fences which now cross or shall hereafter cross said route or routes,and to trim and cut and clear away any trees and brush whenever in its judgment the same shall be necessary for the con- venient and safe exercise of the rights hereby granted,the right to transfer and assign this easement in whole or in part being here- by granted to the Grantee. Grantor agrees that no other easement or easements shall be granted on,under or over said strip of land by Grantor,without the previous written consent of Grantee.
