, as Grantor, for and in consideration of the sum of One Dollar and
other valuable consideration paid by
POWAY MUNICIPAL WATER DISTRICT, a public corporation
as Grantee,receipt whereof is hereby acknowledged,do hereby grant to said
(2) POWAY MUNICIPAL WATER DISTRICT
its successors and assigns,an easement of right of way.MOCCCOOODOCOMXXXX203=05 in,upon,over,under,and across the
lands hereinafter described, to erect,construct, reconstruct, replace, repair, maintain and use a pipeline or pipelines for any and
all purposes,together with their necessary fixtures and appurtenances including but not limited to facilities for power transmission
and communication purposes,at such locations and elevations,upon,along,over and under the hereinafter described right of way
as Grantee may now or hereafter deem convenient and necessary from time to time,together with the right of ingress thereto and
egress therefrom, to and along said right of way by a practical route or routes in,upon,over and across the hereinafter described
lands,together with the right to use said right of way for access to Grantee's rights of way situated in adjacent lands.
The lands in which said easement of right of way is hereby granted are situated in the County of San Diego
State of California,and are particularly described as follows,to wit.
That portion of the East Half of the Southwest Quarter of Section 31, Township 13
South, Range 1 West, San Bernardino Base and Meridian, in the County of San Diego,
State of California, according to United States Government Survey approved September
21, 1875, which lies Southerly of a line described as follows:
Beginning at a point in the Westerly line of said East Half of the Southwest Quarter
of Section 31, which is distant thereon North 01°37155" West 41.75 feet from the
Southwest corner of the Northeast Quarter of said Southwest Quarter; thence South
89°14149" East 633.30 feet; thence North 89°34'21" East 238.22 feet; thence North
89'10111° East 459.00 feet more or less to the East line of said Southwest Quarter
of Section 31.
EXCEPTING the South 132.00 feet thereof.
ALSO EXCEPTING therefrom that portion thereof lying East of the Westerly line of the
County Road known as Road Survey No. 1673 as described in deed to the County of San
Diego recorded February 16, 1967 as File No. 21419 of Official Records of San Diego
County.

Grantor and their successors in estate shall not erect or construct,or permit to be erected or constructed,any building
or other structure,plant any tree or trees,or drill any well or wells,within the limits of said right of way.
Grantee shall have the right to erect,maintain and use gates in all fences which now cross or shall hereafter cross said route or
routes,and to trim and cur and clear away any trees and brush whenever in its judgment the same shall be necessary for the con-
venient and safe exercise of the rights hereby granted,the right to transfer and assign this easement in whole or in part being here-
by granted to the Grantee.
Grantor agrees that no other easement or easements shall be granted on,under or over said strip of land by Grantor,without
the previous written consent of Grantee.
It is also understood and agreed by the parties hereto that the Grantor and their successors or assigns,shall not increase
or decrease,or permit to be increased or decreased, the existing ground elevations of the above described right of way,existing
at the time this document is executed,without the previous written consent of the Grantee.

Deed to the POMERADO COUNTY WATER DISTRICT, filed in the Office of the County Recorder at
said San Diego County September 18, 1961 as Document No. 161899 of Official Records.
The Northerly and Southerly lines of the above described land shall be shortened or
prolonged as necessary on the west so as to terminate in said Easterly line of said 20.00
foot wide easement, and to terminate on the East in the Easterly boundary of saiH lands
first above described.
PARCEL 2:
A strip of land 30.00 feet of even width, said 30. 00 foot wide strip of land lying
Easterly of, and immediately adjoining the Easterly line of that portion of said
20.00 foot wide easement described in Deed to the POMERADO COUNTY WATER DISTRICT
formed by the courses designated in said Deed as "North 5° 15'48" West 347. 13 feet", and
"North 0°43' 15" East 363.40 feet," TOGETHER WITH a strip of land 30.00 feet of even
width, said 30.00 foot wide strip of land lying Westerly of , and immediately adjoining
the Westerly line of that portion of said 20.00 foot wide easement described in Deed
to the POMERADO COUNTY WATER DISTRICT formed by the courses designated in said Deed
as "North 15°45' 14" West 312. 59 feet", "North 32°42' 51" West 267.39 feet", and
"North 3°40' 01" West 145. 55 feet".
The sidelines of the 30.00 foot wide strip of land described in Parcel 2 above,
shall be prolonged or shortened as necessary so as to form a continuous strip of
land terminating on the North in the Southerly line of the land described in Parcel 1
above, and terminating on the South in the Southerly line of the lands first above
described.
PARCEL 3:
All that portion of said lands first above described lying within the boundaries
of the following described land:
Beginning at the angle point in the Westerly boundary of the 30.00 foot wide
strip of land described in Parcel 2 above formed by those certain courses
having bearings of "North 15°45114" West" and "North 0°43115" East"; thence
along said Westerly boundary, North 0°43115" East to the Westerly line of said
20.00 foot wide POMERADO COUNTY WATER DISTRICT easement ; thence along said Westerly
line, North 15°45' 14" West to the Southerly prolongation of that certain course in the
center line of said 20.00 foot wide easement having a bearing of "North 0°43115" East";
thence along said prolongation, South 0°43' 15" West to an intersection with a line which
bears North 15°45' 14" West from the Point of Beginning; thence along said line, South
15°45' 14" East to the Point of Beginning.
PARCEL 4:

An easement for ingress to, and egress from, the land described in Parcels 1 , 2 , and
3 above, and also for the purpose of constructing, reconstructing, replacing, repairing ,
and maintaining the hereinbefore mentioned pipeline or pipelines, and any and all
a)purtendnces incidental thereto constructed within said land described in Parcels 1 , 2,
and 3 above, over, under, upon and across all of said 20.00 foot wide easerr.::nt as
described in Deed to the POMERADO COUNTY WATER DISTRICT.
. TOGETHER WITH an easement for temporary working strips of land, situated within the lands
mov`irst above described, sailkasement shall include, but noilic limited to, the right and
privilege of workmen, conMIRCtors, and any and all agents Miroyed by the Grantee herein, Cn
• to use and occupy said temporary working strips for the purpose of constructing the C'

lines.
Said temporary working strips hereinabove referred to being more particularly described as
Parcels A, B, and C as follows:
PARCEL A:
A strip of land 40.00 feet of even width, lying Southerly of and immediately adjoining
the Southerly line of the land described in Parcel 1 above.
PARCEL B:
A strip of land 35.00 feet of even width, said 35.00 foot wide strip of land lying
Easterly of and immediately adjoining that portion of the Easterly line of the 30.00
foot wide strip of land described in Parcel 2 above having bearings of "North 5° 15'48"
West" and "North 0°43' 15" East".
The sidelines of the 35.00 foot wide strip of land described in Parcel "B" above shall
be prolonged or shortened as necessary so as to terminate on the South in the Easterly
line of the 30.00 foot wide strip of land described in Parcel 2 above, and to terminate on
the North in the Southerly line of the 40.00 foot wide strip of land described in Parcel
"A" above.
PARCEL L:
A strip of land 35.00 feet of even width, said 35.00 foot wide strip of land lying
Westerly of and immediately adjoining the Westerly line of the 30.00 foot wide strip
of land described in Parcel 2 above.
EXCEPTING THEREFROM, that portion thereof included within the boundaries of the property
described in Parcel 3 above, and ALSO EXCEPTING therefrom, that portion thereof included
within said 20.00 foot wide easement described in Deed to the POMERADO COUNTY WATER DISTRICT,
and ALSO EXCEPTING therefrom that portion thereof lying Westerly of the location and
prolongations of that portion of the Westerly line of said 20.00 foot wide easement having
a bearing of "North 0°43' l5" East".
The sidelines of the strip of land described in Parcel "C" above shall be prolonged or
shortened as necessary so as to terminate on the South in the Southerly boundary of the
ands first above described.
It is hereby understood and agreed upon by the Grantor and Grantee herein, that the
right and privilege set forth for the use of the above described temporary working
strips shall be in full force and effect from the date of execution of this instru-
ment, and shall continue in full during the construction of said pipeline, and that upon
completion, final inspection, and acceptance of the pipeline by said Grantee herein,
the easement for the temporary working strips hereby granted and described above, shall
cease and terminate, and become of no further force or effect.
It is also understood and agreed upon by the Grantor and Grantee herein, that the grant
and termination of the easement for the temporary working strips hereinabove described
shall in no way affect or frustrate the continued enjoyment and use of the easements
described in Parcels 1 , 2, 3, and 4 above.
