An easement of right of way in, upon, over, under, and across the lands hereinafter
described to erect, construct, reconstruct, replace, repair, maintain and use a pipe-
line or pipelines for any and all purposes, together with their necessary fixtures and
appurtenances including but not limited to facilities for power transmission and
communication purposes, at such locations and elevations, upon, along, over and under
the hereinafter described right of way as Grantee may now or hereafter deem convenient
and necessary from time to time, together with the right of ingress thereto and egress
therefrom, to and along said right of way by a practical route or routes in, upon, over
and across the hereinafter described lands, together with the right to use said right
of way for access to Grantee's rights of way situated in adjacent lands .
The lands in which said easement of right of way is hereby granted are situated in
the County of San Diego, State of California, and are particularly described as follows:
Parcel 1 of said Parcel Map No. 2745, EXCEPTING THEREFROM, that portion thereof
described in Parcel 1 above, and ALSO EXCEPTING THEREFROM, that portion thereof
described as Parcel 1 in Deed to the Poway Municipal Water District, filed in
the Office of the County Recorder of said San Diego County July 11, 1974, as
Document No. 74-185272 of Official Records.
Said easement of right of way in the aforesaid lands is more particularly described
as follows:
A strip of land 30.00 feet of even width lying within said Parcel 1 of Parcel Map
No. 2745, the Westerly line of said 30.00 foot wide strip of land being described
as follows:
Beginning at the Northeast corner of said property described as Parcel 1 in Deed
to the Poway Municipal Water District, filed in the Office of the County Recorder
of said San Diego County July 11, 1974, as Document No. 74-185272 of Official
Records, being a point on the Northerly line of said Parcel 1 of Parcel Map 2745;
thence along the Easterly line of said property, and along the Southerly prolonga-
tion of said Easterly line, South 03°06'04" East 132.26 feet to the Southerly line
of said Parcel 1.
Parcel 3:
An easement for ingress to, and egress from the 30.00 foot wide strip of land described
in Parcel 2 above and also for the purpose of constructing, reconstructing, replacing,
repairing, and maintaining the hereinbefore mentioned pipeline or pipelines, and any
and all appurtenances incidental thereto constructed within the said 30.00 foot wide
easement described in Parcel 2 above, over, under, upon, and across all that portion
of said Parcel 1 of Parcel Map No. 2745 lying within that certain 20.00 foot wide strip
of land described in Deed to the IOMERADO COUNTY WATER DISTRICT, filed in the Office
of the County Recorder of said San Diego County September 18, 1961 as Document No.
161897 of Official Records.
Grantors herein, their heirs, successors, and assigns hereby acknowledge that the
property described in Parcel 1 above is a portion of a greater parcel owned by Grantors,
said greater parcel being described as follows:
All that real property described in Deed to said Grantors herein, filed in the Office
of the County Recorder of said San Diego County July 12, 1974, as Document No. 74-186810
of Official Records.
Said greater parcel is subject to an assessment lien, being Assessment No. 46, Assessment
Roll No. A-73, issued June 11, 1974, a copy of the Assessment Diagram being filed in the
Office of the County Recorder of said San Diego County June 14, 1974,as FileNo.74-159411.
Grantors herein, their heirs, successors, and assigns, hereby agree that the portion of
said greater parcel not hereby conveyed in fee to the Poway Municipal Water District
shall be liable for the entire assessment lien above referred to, and that none of the
property herein conveyed and described in Parcel 1 above shall be liable for said assess
ment lien or any portion thereof.
Grantors herein, their heirs, successors, and assigns, agree that upon any future
apportionment of said assessment, they will use their best efforts to cause the asses
ment lien against the property herein conveyed and described in Parcel 1 above to be
removed.
