as Grantee may now or hereafter deem convenient and necessary from time to time,together with the right of ingress thereto and

i L 5 tw_ �1R Grantor and successors in estate shall not erect or construct,or permit to be erected or constructed,any building
or other structure,plant any tree or trees,or drill any well or wells,within the limits of said right of way.
Grantee shall have the right to erect,maintain and use gates in all fences which now cross or shall hereafter cross said route or
routes,and to trim and cut and clear away any trees and brush whenever in its judgment the same shall be necessary for the con-
venient and safe exercise of the rights hereby granted,the right to transfer and assign this easement in whole or in part being here-
by granted to the Grantee.
Grantor agrees that no other easement or easements shall be granted on,under or over said strip of land by Grantor,without
the previous written consent of Grantee.
It is also understood and agreed by the parties hereto that the Grantor and i tS successors or assigns,shall not increase
or decrease,or permit to be increased or decreased, the existing ground elevations of the above described right of way,existing
at the time this document is executed,without the previous written consent of the Grantee.

AN INTEREST IN REAL PROPERTY
NOTICE IS HEREBY GIVEN that the Governing Board of the
Poway Unified School District on
July 14 . 1975 , adopted a resolution of intention to
dedicate to Poway Municipal Water District a Grant of
Right of Way
across property of this district located at Tierra Bonita
School, 14678 Tierra Bonita Road, Poway , California
(a description of the purposes of the easement, of the route therein
and other particulars of the dedication are on file and may be
examined in the office of the Director of Facilities Services
of the Poway Unified School District)
.nd has set 7 : 30 p.m. , July 28 , 1975 atMeadowbrook
School, 12320 Meadowbrook Lane, Poway, California for a
public hearing upon the question of making such dedication, at which
time interested persons may appear and protest .

On motion of Member Norman , seconded by Member
Nixon , the following resolution is adopted:
WHEREAS , this Board on July 14 1975 , adopted a Resolution
of Intention to Dedicate an Interest in Real Property described
therein to the Poway Municipal Water District
through, over, under, along and _cross property described therein and
owned by this District; and
WHEREAS , said Resolution. provided that a public hearing cn the
question of making such d-dication be held by this Board at its
regular place of meeting on July 28 , 1975 , at 7 : 30 _p.m. , at
which time and place all persons interested ti,c rein might appear and
show cause why said dedication should not be made; and
WHEREAS , notice of the adoption of said Resolution of Intention
was duly given as provided by law, all of which appears by the
affidavits of posting and publication on file in the office of this
Board; and
WHEREAS , tris Board formally convened at the time and place set
forth in said Resolution of Intention , and no person appeared to
object to or protest either verbally or in writing against the dedica-
tion of the easement described in said Resolution; and
WHEREAS , in the judgment of this Board it is expedient and for
the best intere:,ts of this District that said dedication be made; NOW
THEREFORE ,
BE IT RESOLVED AND ORDERED by the Governing Board of the
Poway Unified School District
of San Diego County that an interest in real property for the purposes
described in the resolution of intention adopted by this Board on
July 14, 1975 , be and it is hereby dedicated to the
Poway Municipal Water District ;
BE IT FURTHER RESOLVED AND ORDERED that the President of thi
Board be and is hereby authorized and directed to execute and deliver
a deed of dedication of the interest in real property described in
said Resolutionof Intention to said applicant .

On motion of MemberTay1 , seconded by Member
Todd , the following resolution is adopted:
WHEREAS , Poway Municipal Water District
requested this Board to dedicate an interest in real property to
said applicant for purposes set forth below; and
WHEREAS , in the judgment of this Board public convenience makes
it expedient that said request be granted ; NOW THEREFORE
BE IT RESOLVED AND ORDERED pursuant to the provisions of the
Education Code , Section 16251 et seq . , that the Governing Board of
the Poway Unified School
District of San Diego County, California , hereby declares that it is
the intention of this Board to dedicate to Poway Municipal Water
District upon the terms and conditions that are set forth in that
certain form entitled Grant of Right of Way
a copy of which is attached hereto marked Exhibit "A" and by this
reference made a part hereof, an easement in real property belonging
to said District and more particularly described in said Exhibit "A"
to install , place , replace , operate , maintain and repair within and
along the pipelines of the District ' s water system, together with the
right of ingress thereto and egress therefrom, through, over , under ,
along and across real property belonging to said District and more
particularly described in said Exhibit "A" .
BE IT FURTHER RESOLVED AND ORDERED that a public meeting be held
by this Board at its regular place of meeting , Meadowbrook
Middle School , 12320 Meadowbrook Lane , Poway ,
California , on July 28 , 1975, at 7 : 30 p .m. , at which time
all persons interested may appear and show cause if any they have why
said dedication should not be made .
BE IT FURTHER RESOLVED AND ORDERED that notice of the adoption
of this resolution and of the time and place of holding said meeting
shall be given by posting copies of said resolution, signed by the
members of this Board, or by a majority thereof, in three (3) public
places in said District not less than ten (10) days before the date
of said meeting and by publishing the notice attached hereto , marked
Exhibit "B" , once not less than five (5) days before the date of the
