subject and subordinate the liens thereof to the Easement granted by
Vivi Higbee
to POWAY MUNICIPAL WATER DISTRICT, it being understood and agreed that
foreclosure of said Deed of Trust shall not affect, defeat or render invalid
any rights under and by virtue of said easement, and said easement shall be
paramount and superior to the rights of any purchaser under a foreclosure
of said Deed of Trust.
Said easement is described in EXHIBIT "A" attached hereto and affects the
real property described in the said Deed of Trust,
Vivi Higbee as Trustor,
California FirstBank as Trustee,
and California FirstBank as Beneficiary.
Beneficiary declares and acknowledges that it hereby intentionally waives,
relinquishes and subordinates the priorities and superiorities of the lien
and charge of said Deed of Trust upon the land described therein in favor
of said easement, and that it understands that in reliance upon and in
consideration of this waiver, relinquishment and subordination specific
monetary and other obligations will be entered into by Third Parties which
would not be made or entered into but for said reliance and the execution
by Beneficiary of this waiver, relinquishment and subordination.

An easement of right of way 20.00 feet in width in, upon, over, under and across
the lands hereinafter described, to erect, construct, reconstruct, replace, repair
maintain and use a pipeline or pipelines for any and all purposes, together with
their necessary fixtures and appurtenances including but not limited to facilities
for power transmission and communication purposes, at such locations and elevations
upon, along, over and under the hereinafter described right of way together with
the right of ingress thereto and egress therefrom, to and along said right of way
by a practical route or routes in, upon, over and across the hereinafter described
lands, together with the right to use said right of way for access to adjacent
lands.
The lands in which said easement of right of way is hereby granted are situated
in the County of San Diego, State of California, and are particularly described
as follows, to wit:
The Westerly 385.05 feet of that portion of Lot 3 in the Northwest Quarter of the
Southwest Quarter in Section 18, Township 14 South, Range 1 West, San Bernardino
Base and Meridian, in the County of San Diego, State of California, described as
follows:
COMMENCING at the Southeast corner of said Lot 3, thence West along the South line
of said Lot to the West line of the East 825.00 feet of said Lot; thence North
01°24'00" West along said West line of the East 825.00 feet, 708.21 feet, more or
less, to the point of intersection of a line parallel with and 214.00 feet
Southerly measured at right angles from the Southerly line of land as described
in deed to John H. Rens and wife, dated February 17, 1948 and recorded in Book
2703 page 373 of Official Records; thence South 89°12'50" East along said
parallel line to a point of intersection with a line which is parallel with and
180.00 feet Easterly measured at right angle from said West line of the East 825.00
feet; thence South 01°24'00" East, 10.00 feet to the TRUE POINT OF BEGINNING:
thence retracing the last two courses and distances North O1°24'00" West, 10.00
feet and North 89°12'50" West, 180.00 feet, more or less , to the West line of the
East 825.00 feet; thence North 01°24'00" West along said West line to the East
825.00 feet, 214.00 feet to the Southwest corner of said Rens land: thence South
89°12'50" East, along the South line of said Rens land to the Southeast corner
thereof; thence continuing South 89°12'50" East to the East line of said Lot 3;
thence along the East line of said Lot 3, South O1°24'00" East, 224.00 feet,
more or less, to the point of intersection of a line which is parallel with and
224.00 feet Southerly measured at right angles from the Southerly line of said
Rens land, and being a line that bears South 89°12'50" East from the TRUE POINT OF
BEGINNING; thence North 89°12'50" West, 645.00 feet, more or less, to the TRUE
POINT OF BEGINNING.
Said easement of right of way in the aforesaid lands is particularly described as
follows:
All the portion of the Southerly 20.00 feet of the above described property
lying Easterly of a line which bears North 1°24'00" West from the TRUE POINT OF
BEGINNING of said above described property.
