Parcel 1 :
All that portion of Parcel 3 of Parcel Map No. 10293, filed in the Office of
the County Recorder of said San Diego County August 1 , 1980, said Parcel
Map No. 10293 being portions of the North Half of the Southeast Quarter of
Section 8, Township 14 South, Range 1 West, San Bernardino Meridian, in the
City of Poway, County of San Diego, State of California , described as follows:
Commencing at the Southwest corner of said Parcel 3; thence along the Southerly
boundary thereof, South 88°28'44" East (record South 88°59 '50" East) 450.03
feet, and South 62°17 '35" East (record South 62°48'41 " East) 23.57 feet to
the TRUE POINT OF BEGINNING; thence continuing along the Southerly boundary of
said Parcel 3, South 62°17' 35" East 611 .51 feet; thence North 1 °31 '16" East
269.85 feet to a line which bears South 88°28'44" East from the TRUE POINT OF
BEGINNING; thence along said line, North 88°28'44" West 548.75 feet to the
TRUE POINT OF BEGINNING.
Parcel 2:
Easements of rights of way to erect, construct, reconstruct, replace, repair,
maintain and use a pipeline or pipelines for any and all purposes , together
with their necessary fixtures and appurtenances including but not limited to
facilities for power transmission and communication purposes , at such locations
and elevations, upon, along, over and under the hereinafter described rights
of way as Grantee may now or hereafter deem convenient and necessary from
time to time, together with the right of ingress thereto and egress therefrom,
to and along said rights of way by a practical route or routes in, upon, over,
and across the lands of the grantor herein, said easements being over, under,
upon, and across those portions of said Parcel Map No. 10293 described in
Parcels A, B, C, and D as follows :
Parcel A:
A strip of land 60.00 feet of even width, the center line of said 60.00
foot wide strip of land being described as follows :
Beginning at the Northeast corner of Parcel 1 of said Parcel Map No. 10293;
thence along the Easterly boundary of said Parcel 1 , South 1 °31 '16" West
(record South 1 °00'10" West) 776.11 feet to the Southeast corner of said
Parcel 1 .
The Easterly line of the above described 60.00 foot wide strip of land
shall be prolonged Northerly as necessary so as to terminate in the Northerly
boundary of said Parcel Map No. 10293.
Parcel B:
A strip of land 30.00 feet of even width, the Northwesterly line of said
30.00 foot wide strip of land being described as follows :
Beginning at the Southerly terminus of the center line of the 60.00 foot
wide strip of land described in Parcel 2-A above; thence South 55°48'00"

in Parcel 2-B above shall be prolonged as necessary so as to terminate

EXCEPTING from the 30.00 foot wide strip of land described in Parcel
2-B above, that portion thereof lying Easterly of the Southerly
prolonation of the Easterly line of the 60.00 foot wide strip of land
described in Parcel 2-A above.
Parcel C:
All that portion of the Southerly 30.00 feet of said Parcel 2 of
Parcel Map No. 10293 lying Westerly of the Northwesterly line of the
30.00 foot wide strip of land described in Parcel 2-B above.
Parcel D:
A strip of land 30.00 feet of even width , the Southerly and Southwesterly
line of said 30.00 foot wide strip of land lying 17.00 feet Southerly
and Southwesterly, measured at right angles and radially, from the
following described line:
Commencing at the Southwest corner of Parcel 3 of said Parcel Map No.
10293, being also the Northwest corner of Parcel 4 of said Parcel Map
No. 10293; thence along the Westerly boundary of said Parcel 4, South
1 °31 '16" West (record South 1 °00'10" West) 13.00 feet to a line drawn
parallel with, and distant 13.00 feet Southerly, measured at right angles ,
from that certain course in the Northerly boundary of said Parcel 4
which is designated on said Parcel Map No. 10293 as "North 88°59 '50"
West 450.03 feet," being the TRUE POINT OF BEGINNING; thence along said
parallel line, South 88°28'44" East 400.46 feet to the beginning of a
tangent 200.00 foot radius curve, concave Southerly; thence Easterly
along the arc of said curve, through a central angle of 26°11 '09" a distance
of 91 .41 feet to its point of tangency with a line drawn parallel with and
distant 13.00 feet Southwesterly, measured at right angles , from that certain
course in the Southerly boundary of said Parcel 3 of Parcel Map No. 10293
which is designated thereon as "North 62°48'41 " West 728.38 feet"; thence
along said parallel line, South 62°17'35" East (record South 62°48'41 "
East) 50.26 feet to the beginning of a tangent 273.00 foot radius curve,
concave Northeasterly; thence Southeasterly along the arc of said curve
to the Northerly boundary of said Parcel 4 of Parcel Map No. 10293.
The Southwesterly line of the above described 30.00 foot wide strip
of land shall be continued Southeasterly so as to terminate on the
East in said Northerly boundary of Parcel 4 of Parcel Map No. 10293.
TOGETHER WITH that portion of said Parcel 4 of Parcel Map No. 10293
lying between the arc of the 213.00 foot radius curve forming a portion
of the Northerly line of the 30.00 foot wide strip of land described in
Parcel 2-D above, and the semi -tangents of said 213.00 foot radius curve.
Parcel 3:
An easement for the construction, maintenance, repair, and use of an
access road over, under, upon, and across all that portion of Parcel 4 of
said Parcel Map No. 10293 described in Parcel 2-D above, TOGETHER WITH all
that portion of the 60.00 foot wide strip of land described in Parcel 2-A
above lying Northerly of the Westerly prolongation of the Southerly line of
the 30.00 foot wide strip of land described in said Parcel 2-D above.

TOGETHER WITH an easement and right to construct, reconstruct, repair, and
maintain excavation and embankment slopes beyond the limits of the property
described in Parcel 3 above where required for the construction and maintenance
of said access road; reserving to the grantors herein, their successors and
assigns, the right to remove such slopes or pertiors thereof, provided that
said grantor herein has removed the necessity for maintaining such slopes or
portions thereof, or upon providing in place thereof, where necessary, other
adequate lateral support, the design and construction of which shall be first
approved by the grantee herein , and also provided that the said grantee herein
has given its previous written consent to such removal .
Parcel 4:
An easement for the construction, maintenance, repair, and use of a road
for the purpose of the construction , reconstruction, replacement, repair,
maintenance and use of a pipeline and/or pipelines , over, upon, and across
all of the property described in Parcels 2-B and 2-C above, TOGETHER WITH
all that portion of the 60.00 foot wide strip of land described in Parcel
2-A above lying Southerly of the Westerly prolongation of the Southerly line
of the 30.00 foot wide strip of land described in Parcel 2-D above.
TOGETHER WITH an easement and right to construct, reconstruct, repair, and
maintain excavation and embankment slopes beyond the limits of the property

1 above, distant thereon approximately 350.00 feet Southeasterly from the
most Westerly corner thereof.
Parcel 6:
An easement for the construction, reconstruction, repair, and maintenance of
a drainage ditch or ditches , and/or a drainage pipe or pipes , over, under,
upon, and across all that portion of Parcel 2 of said Parcel Map No. 10293
included within a strip of land 15.00 feet of even width, the center line
of said 15.00 foot wide strip of land being described as follows :
Commencing at the Northeasterly terminus of the Northwesterly line of the
30.00 foot wide strip of land described in Parcel 2-B above; thence along
said Northwesterly line, South 55°48'00" West 177.71 feet; thence South
80°48'00" West 42.00 feet to the TRUE POINT OF BEGINNING; thence North 80°
48'00" East to the Southeasterly line of said 30.00 foot wide strip of land
described in Parcel 2-B above.

upon, and across all that portion of Parcels 1 and 4 of said Parcel Map No.
10293 included within a strip of land 15.00 feet of even width, the center
line of said 15.00 foot wide strip of land being described as follows:
Beginning at a point on the center line of the 60.00 foot wide strip of land
described in Parcel 2-A above, distant thereon North 1 °31 '16" East 22.44 feet
from the Southerly terminus of said center line; thence South 69°31 ' 16" West
to the Westerly line of said 60.00 foot wide strip of land, being the TRUE
POINT OF BEGINNING; thence North 69°31 '16" East 80.00 feet.
Parcel 8:
An easement for the construction, reconstruction, repair, and maintenance
of a drainage ditch or ditches , and/or a drainage pipe or pipes , over, under,
upon, and across all that portion of Parcels 1 and 4 of said Parcel Map No.
10293 included within a strip of land 15.00 feet of even width, the center
line of said 15.00 foot wide strip of land being described as follows :
Beginning at a point on the center line of the 60.00 foot wide strip of land
described in Parcel 2-A above, distant thereon North 1 °31 '16" East 138.72
feet from the Southerly terminus of said center line; thence South 81 °31 ' 16"
West to the Westerly line of said 60.00 foot wide strip of land, being
the TRUE POINT OF BEGINNING; thence North 81 °31 ' 16" East 70.00 feet.
Grantor and their successors in estate shall not erect or construct, or permit
to be erected or constructed, any building or other structure, plant any tree
or trees, or drill any well or wells within the limits of said rights of way.
Grantee shall have the right to erect, maintain and use gates in all fences
which now cross or shall hereafter cross said route or routes , and to trim and
cut and clear away any trees and brush whenever in its judgment the same shall
be necessary for the convenient and safe exercise of the rights hereby granted,
the right to transfer and assign this easement in whole or in part being hereby
granted to the Grantee.
It is also understood and agreed by the parties hereto that the Grantor and
their successors or assigns, shall not increase or decrease, or permit to be
increased or decreased, the ground elevations of the above described rights of
way, without the previous written consent of the Grantee.
Notwithstanding any other provision of this document, Grantor herein specifically
reserves to himself, and his heirs, successors and assigns, the right to
grant easements for road purposes to others over and across the strips of land
described in Parcels 2-B, 2-C, and 2-D above.
