A ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF POWAY
APPROVING ZONE I~ECLASSIFICATION I~EQUEST
R-81-076 AXTELL DEVELOPMENT CORPORATION
LOCATED SOUTHEAST OF THE SOUTHERLY TEI~INUS OF GATE DRIVE
APN: 323-090-34, 35, 36, 50 AND 51
WHEREAS, on the twenty-seventh day of July, 1982, the City
Council considered the above referenced application; and
WHEREAS, the City Council has held duly advertised Public
Hearings pursuant to Section 65854 of the California Government Code.
NOW, THEREFORE, BE IT ORDAINED that the City Council of the City
of Poway does hereby find:
Section 1: Findings
That the subject property is suitable for the uses
permitted in the proposed zone in terms of access,
size, and comparability with existing land use in the
surrounding area because surrounding properties are
also residential lots of one acre and greater.
That the proposed zone reclassification would not have a
significant impact on the environment and the
surrounding properties because necessary public services
and facilities are a part of improvements for a major
subdivision in conjunction with the zone
reclassification.
That the proposed zone reclassification is in
conformance with the Poway Genreral Plan because lot
sizes of one, two, and four acres are permitted on this
property by the General Plan.
Section 2
Pursuant to Section 65850 through 65855 of the California
Government Code the City Council of the City of Poway hereby
approves Zone Reclassification R-81-076 (Axtell Development
Corporation).
Section 3
The City Council certifies the Environmental Impact Report
as adequate for the Zoning Reclassification R-81-076 (Axtell
Development Corporation).

Section 4
The zoning classification described below is hereby changed
as follows:
OLD ZONE: Use Regulations A-70-4, Neighborhood Designator
L, Density one DU per four acres, lot size four acres net,
Building Type C, Maximum Floor Area -, Floor Area Ratio -,
Height G, Lot Coverage -, Setbacks B, Open Space -, Special
Area Regulations.
NEW ZONE: Use Regulations R-R-5, Neighborhood Designator L,
Density one DU per two acres net, lot size two acres net,
Building Type C, Maximum Floor Area -, Floor Area Ratio -,
Height G, Lot Coverage -, Setbacks B, Open Space -, Special
Area Regulations -.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 27th day of July, 1982.
