BACKGROUND Some weeks ago, Councilmember Emery expresed concern about the fate of older buildings in the community. Although the Planning Services_ Department applied for a grant in November 1985 from the State ' Office of Historic Preservation to do a historic resources survey within the City, Poway was not selected as a grant recipient. We will reapply again this November, but if we are successful, the grant would not be received until June 1987 and the survey that it would fund will take approximately 11 months to complete (May 1988) . Staff will undertake a limited historical review as time and funds permit; however , some action is needed to address the demolition of potentially significant buildings during the interim. The attached draft ordinance has been prepared for City Council review and discussion. C RECOMMENDATION • It is recommended that the City Council review the attached draft ordinance and direct Staff to schedule a future public hearing for its consideration. Attachment: • 1 . AN ORDINANCE OF THE CITY OF :POWAY, CALIFORNIA ADDING SECTION 15 . 20 .140 TO THE POWAY MUNICIPAL CODE, REQUIRING AN HISTORIC STUDY FOR ALL BUILDINGS CONSTRUCTED BEFORE 1940 PRIOR TO THEIR DEMOLITION OR RELOCATION WHEREAS, the Historic Preservation Element of the Comprehensive Plan calls for a comprehensive survey ,to be undertaken to identify and evaluate historic structures and places in Poway; and WHEREAS, the City will be applying for a survey grant from the California Office of Historic Preservation in November , 1986 ; and WHEREAS, the Survey will take approximately 11 months to complete once the survey grant is available; and WHEREAS, the present building code permits the immediate destruc- tion of any structure without time to review reasonable means by which significant structures may be preserved, relocated, or re-used. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: Section 1 : Section 15 . 20 . 140 shall be added to the Poway Municipal Code as follows : 15 . 20 .140 Demoliton/Relocation of Older Buildings . A. Prior to the demolition or relocation of any building constructed prior to 1940 , the owner shall provide the City with an historic study of said building prepared by a con- sultant acceptable to the Director of Planning Services . B. The historic study shall include but not be limited to title and other record searches, architectural descriptions, photographs, and written descriptions pertaining to the building and site. C . Following its review of the historic study, the City Council shall determine whether the demolition of the building represents a significant loss in terms of the City' s heritage. If the loss is determined to be signifi- cant, the building shall not be demolished; further , as a condition of approval of any development of the subject site, the building shall be preserved on its existing site or relocated to an approved site within the City. 20F3 JUL 101986 ITEM 11 0 Ordinance No. Page 2 • EFFECTIVE DATE: This ordinance shall take effect and be in force thirty ( 30) days after the date of its passage; and before the expira- tion of fifteen ( 15 ) days after its passage, it shall be published once with the names and members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation published in the City of Poway.
