Joshua Malowney and Patrizia lavicoli, ("OWNER" hereinafter), is the owner of real
property located in the City of Poway, California, commonly known as 15474 Markar Road and
more particularly described as Parcel 2 in the City of Poway, County of San Diego, State of
California, as shown on Parcel Map number 11254, filed in the Office of the County Recorder of
San Diego County, April 30, 1951 ("PROPERTY" hereinafter). In consideration of the approval
of Underground Waiver (UW) 18-001, by the City of Poway ("CITY" hereinafter), OWNER hereby
agrees for the benefit of the CITY, not to oppose a future private or public utilities undergrounding
district that includes PROPERTY and to pay a pro rata share of future undergrounding costs that
includes PROPERTY.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party.
