P-18-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP 18-001; A ONE-YEAR TIME EXTENSION OF THE APPROVAL FOR TENTATIVE PARCEL MAP 08-002 ASSESSOR'S PARCEL NUMBERS (APN): 317-200-26 WHEREAS, on November 1, 2016, the City Council approved Tentative Parcel Map (TPM) 08-002, for a 2 -lot subdivision of an approximately 2.2 -acre property located at 12251 Sunwood Trail in the Rural Residential C (RR -C) zone; WHEREAS, Bill Yen, Inc., (Applicant), on behalf of DKK Family Trust 03-21-04, (Property Owner), has submitted a request (TPM 18-001) pursuant to Section 16.10.080 of the Poway Municipal Code (PMC) for a one-year extension of the project approval; WHEREAS, TPM 08-002 expires two years from the approval date, November 1, 2018. Upon submittal of a time extension request, the expiration is automatically extended 60 days, to December 31, 2018 (Government Code 66452.6(e)); WHEREAS, on November 7, 2018, the City Council held a duly advertised public hearing to solicit comments from the public, both for and against, relative to this application; and WHEREAS, the City Council has read and considered the agenda report for the proposed revisions to the project and has considered other evidence presented at the public hearing. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: The project is Categorically Exempt from the California Environmental Quality Act (CEQA), as Class 15 Categorical Exemption, Section 15315 of the CEQA Guidelines, in that the project involves the division of land into two parcels within an urbanized area in compliance with all City codes and standards and the average slope of the property is less than 20 percent. Biological impacts related to this activity are adequately addressed by and consistent with the City of Poway's Subarea Habitat Conservation Plan (PSHCP), companion Implementing Agreement dated June 1996, and associated Mitigated Negative Declaration. Section 2: City Council Resolution P-16-27 remains in full force and effect except that a time extension for the approval is hereby granted by the City Council. The time extension for approval shall be for one year from November 1, 2018. Section 3: The parties are hereby informed that the time within which judicial review of this decision must be sought is governed by Section 1094.6 of the California Code of Civil Procedure. Section 4: The approval of TPM 18-001 expires on November 1, 2019, at 5:00 p.m. The final parcel map (FPM) conforming to this conditionally approved TPM shall be filed with the City so that the City may approve the FPM before this approval expires, unless at least 90 days prior to the expiration of the TPM a request for a time extension is submitted to the Development Services Department and a time extension is subsequently granted by the City Council.
