SUBJECT: Acceptance of the Swim Center Renovation Project; Bid No. 18-008 Hamel Contracting, Inc. Summary: On November 21, 2017, the City Council awarded the contract for the Swim Center Renovation Project; Bid No. 18-008, to Hamel Contracting, Inc., in the amount of $3,196,008.00. This action will accept the project as complete. Recommended Action: It is recommended that the City Council: (1) Accept the Swim Center Renovation Project as complete; (2) Authorize the City Clerk to file and record the Notice of Completion; (3) Authorize the release of the retention in the amount of $172,201.09, if unencumbered, 45 days after City Council acceptance; and (4) Release the North American Specialty Insurance Company Bond for Material and Labor in the amount of $3,196,008.00 after the release of retention; and (5) Retain the North American Specialty Insurance Company Bond for Faithful Performance for a period of one year. Discussion: The Swim Center Renovation Project consisted of several individual components. All the work associated with this project was grouped into four tasks, as follows: The first task removed and replaced the entire reinforced concrete deck, pool plaster and tile, installed a new three -meter dive platform and deck accessory inserts, and constructed a new pool accessory storage area. The second task rehabilitated the pool's mechanical systems which consisted of the removal and replacement of control valves, rehabilitation of the existing chlorine delivery system, installation of a new acid delivery system, rehabilitation of the existing sand filters and the replacement of the two outdated and inefficient pool water heaters. The third task included the construction of a new splash zone. This zero -depth water play area replaced the wading pool that was not code compliant. 1 of 2 March 19, 2019, Item # i - 5 Acceptance of the Swim Center Renovation Project March 19, 2019 Page 2 The fourth task included required upgrades and modernization of amenities within the shower locker room, such as the construction of family restrooms, private shower stalls, private changing stalls and the modification of the existing toilet stalls to bring them into building code compliance. Work also included the construction of a new administration/entrance building that allows for a gender/age neutral entrance into the facility. There were six Change Orders for this project totaling $248,013.76 which totals 7.76% of contract. The change orders were for the following reasons: redesign and changes in construction due to unforeseen conditions as a result of working in an old facility, such as concrete encased to?let mounts where relocation of toilets was necessary and the location of underground piping and electrical conduits not being where anticipated. Added scope items included replacement of the pool lights and the pool perimeter fence. The final contract amount is $3,444,021.76. The contractor continues to work on warranty items related to the construction. Environmental Review: The matter of acceptance of public improvements that have been completed, which were the subject of a prior environmental determination, is not subject to the California Environmental Quality Act. Fiscal Impact: Sufficient funds are available in the Swim Center Renovation Project account (BDG0002) for the release of retention. After the retention payment of $172,201.09, the Swim Center Renovation Project account (BDG0002) will have an available balance of $149,449.93.
