RESOLUTION NO. 04- 071
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, CONSENTING TO AND CALLING FOR A JOINT PUBLIC
HEARING ON THE PROPOSED 2004 AMENDMENT TO THE
REDEVELOPMENT PLAN FOR THE PAGUA Y REDEVELOPMENT PROJECT
AREA
WHEREAS, the City Council of the City of Poway ("City Council") has
undertaken steps to amend the Redevelopment Plan for the Paguay
Redevelopment Project Area ("Project Area"), and
WHEREAS, the City Council is required to complete the actions
prescribed by Sections 33354.6 of the California Community Redevelopment
Law, Health and Safety Code Section 33000 et sea. ("CRL"); and
WHEREAS, pursuant to the provisions of the CRL, staff and consultants of
the Agency have prepared a draft Amendment to the Redevelopment Plan for the
Project Area ("2004 Amendment") pursuant to the requirements of the CRL and
California Environmental Quality Act; and
WHEREAS, pursuant to Sections 33450 through 33458 of the CRL, a joint
public hearing on the proposed Amendment may be held with the consent of the
City Council and the Poway Redevelopment Agency.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway as follows:
Section 1. A joint public hearing of the City Council of the City of Poway
and the Poway Redevelopment Agency is hereby consented to and called for.
The purpose of the proposed 2004 Amendment is to extend the time limit for
eminent domain authority in portions of the Project Area already subject to
eminent domain.
Section 2. The hearing is to be held in the City Council Chambers to act
upon the proposed 2004 Amendment, and all documents and evidence
pertaining thereto. The date and time of such joint public hearing shall be
Tuesday, September 28, 2004, at 7:00 p.m. or soon thereafter as the matter may
be heard.
Section 3. Staff is hereby authorized and directed to prepare, publish,
and mail such notices and documents required by the CRL that are necessary to
carry out the purposes of this Resolution.

PASSED, ADOPTED AND APPROVED by the City Council of the City of
Poway at a regular meeting this 17th day of August 2004.
