RESOLUTION NO. 04-072
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
DETERMINING THAT THE
COMMUNITY ROAD SOUNDWALL PROJECT
IS OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT
WHEREAS, the Poway Redevelopment Agency is authorized to carry out the
redevelopment of the Poway Redevelopment Project Area; and
WHEREAS, the Poway Redevelopment Agency, in partnership with the local
business and residential community, has identified a need for noise reduction for
residential properties along major arterials within the community; and
WHEREAS, the Community Road Soundwall Project is proposed to be located
within the Paguay Redevelopment Project Area and the improvements are necessary for
the execution of the Project under the provisions of California Community Redevelopment
Law (Health and Safety Code, Section 33000 et seq.) and pursuant to the Redevelopment
Plan for the Project which was adopted on December 13, 1983, by Ordinance No. 117 of
the City Council and amended on June 15, 1993, by Ordinance No. 415 of the City
Council; and
WHEREAS, Section 33445 of the California Health and Safety Code requires the
City Council of the City of Poway to determine that the project is of benefit to the Paguay
Redevelopment Project and that no other reasonable means of financing are available to
the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1. The City Council hereby determines that the Community Road Soundwall
Project, which will reduce noise to residential properties located adjacent to the expanded
Community Road, a major arterial within the community, will be of benefit to the Paguay
Redevelopment Project and the surrounding community in that the improvements will
reduce noise to residential properties adjacentto the expanded Community Road. Further,
the project will meet goals listed in the Redevelopment Plan, as amended on June 15,
1993, and in the Redevelopment and Housing Implementation Plan, which includes the
elimination of blighting conditions, both visual and from traffic noise, enhances the visual
appearance of the Community Road corridor, and provides separation between the
Community Road traffic circulation and residential sites.
Section 2. The City Council further determines that no other reasonable means of
financing the improvements are available to the community.
Section 3. The Interim City Clerk shall certify to the adoption of this Resolution.

PASSED, ADOPTED AND APPROVED, by the City Council of the City of Poway at
a regular meeting this 31st day of August, 2004.
