RESOLUTION NO.04-082
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
ORDERING THE VACATION
OF A PORTION OF SYCAMORE AVENUE,
ADJACENT TO LOTS 15 AND 16
IN BLOCK 24 OF PIERMONT, MAP NO. 785, APN 314-213-02
(VACATION 04-02)
WHEREAS, the City Council of the City of Poway desires to vacate a portion of
Sycamore Avenue south of Edgemoor Street, adjacent to Lots 15 and 16 in Block 24 of
Piermont, Map No. 785, in accordance with the procedures provided in Part 3,
commencing at Section 8300, of Division 9, of the State of California Streets and
Highways Code; and
WHEREAS, Sycamore Avenue was dedicated for public street purposes as
shown on the final map of Piermont, Map No. 785.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1. This Vacation is made under the provisions of Chapter 3, Part 3, Division 9 of the
State of California Streets and Highways Code.
2. The City hereby finds that said portion of Sycamore Avenue to be vacated is
unnecessary for present or prospective public street use.
3. The City hereby declares that said portion of Sycamore Avenue south of
Edgemoor Street, adjacent to Lots 15 and 16 in Block 24 of Piermont, Map No.
785, more particularly described as the westerly half of the 80.00-foot-wide street
right-of-way, is hereby vacated, subject to the reservations stated in item 4
below.
4. The City hereby reserves and excepts from the Vacation as follows:
a. An easement to San Diego Gas & Electric Company for electric facilities
over, under, and along the Easterly 20.00 feet of the Westerly 40.00 feet
of said portion of Sycamore Avenue.
b. An easement to Cox Communications over, under, and along the said
portion of Sycamore Avenue.

5. The City Clerk of the City of Poway is hereby directed to cause a certified copy of
this Resolution to be recorded in the office of the San Diego County Recorder.
6. That from and after the date the Resolution is recorded, the Vacation is
complete.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 28th day of September, 2004.
