RESOLUTION NO. 04-086
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
APPROVING AN APPLICATION FOR GRANT FUNDS FOR THE ROBERTI-l'BERG-
HARRIS BLOCK GRANT PROGRAM UNDER THE CALIFORNIA CLEAN WATER,
CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND COASTAL PROTECTION ACT
OF 2002; AND RESCINIDNG RESOLUTION NO. 04-021.
WHEREAS, the people of the State of California have enacted the California
Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act of 2002
which provides funds for the Roberti-l'Berg-Harris Block Grant Program for grants to
eligible Applicants; and
WHEREAS, the California Department of Parks and Recreation has been
delegated the responsibility for the administration of the grant program, setting up
necessary procedures; and
WHEREAS, said procedures established by the California Department of Parks
and Recreation require the Applicant's governing body to certify by resolution the
approval of the Applicant to apply for the Roberti-l'Berg-Harris grant allocation; and
WHEREAS, the Applicant will enter into a Contract with the State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1. The filing of an application for local assistance funds from the Roberti-
Z'Berg-Harris Block Grant Program under the California Clean Water, Clean Air, Safe
Neighborhood Parks and Costal Protection Act of 2002 is approved; and
Section 2. The City of Poway certifies that it has or will have sufficient funds to
operate and maintain the Project(s); and
Section 3. The City of Poway certifies that it has reviewed, understands and
agrees to the General Provisions contained in the Contract shown in the Procedural
Guide; and
Section 4. The City of Poway certifies that the Project conforms to the recreation
element of any applicable city or county general plan; and
Section 5. The Director of Public Works is appointed as agent to conduct all
negotiations, execute and submit all documents including, but not limited to
applications, agreements, payment requests and so on, which may be necessary for the
completion of Project(s); and

Section 6. Resolution No. 04-021 is hereby rescinded.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway
at a regular meeting this 5th day of October 2004.
