Res 04-100 RESOLUTION NO. 04- 100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY AFFIRMING ITS INTENTION THAT CERTAIN PROPERTY ACQUIRED BY THE POWAY REDEVELOPMENT AGENCY BE DEVELOPED AS AFFORDABLE HOUSING AND EXTENDING THE PERIOD DURING WHICH THE POWAY REDEVELOPMENT AGENCY MAY RETAIN THE PROPERTY WHEREAS, Section 33334.2, et seq., of the California Health and Safety Code authorizes a redevelopment agency to acquire real property and building sites with funds from the redevelopment agency's Low and Moderate Income Housing Fund, which real property is to be used to increase, improve and preserve the community's supply of affordable housing for low and moderate income persons; and WHEREAS, the Poway Redevelopment Agency (the "Agency") acquired a 2.06 Acre parcel of real property located 12674 Monte Vista Road in the City of Poway (the "Monte Vista Property") with funds from the Agency's Low and Moderate Income Housing Fund (the "Housing Fund") in January of 2000; and WHEREAS, Health and Safety Code Section 33334.16 requires that, for property acquired using monies from the Housing Fund, the Agency shall initiate activities consistent with the development of the property for affordable housing purposes within five years from the date the Agency acquires such real property; and WHEREAS, Health and Safety Code Section 33334.16 further provides that if the Agency has not initiated activities consistent with the development of the property for affordable housing purposes within five years from the date the Agency acquires the real property, the City Council, as the legislative body of the City, may extend the period during which the Agency may retain the property for a period not to exceed five years; and WHEREAS, the Agency has begun discussions with Accessible Spaces, a developer specializing in housing for disabled persons, regarding the potential development of housing on the Monte Vista Property; and WHEREAS, Accessible Spaces, in partnership with the. San Diego Brain Foundation, has applied to the United States Department of Housing and Urban Development (the "Department") for funds to develop low and moderate income housing at the Monte Vista Property; and WHEREAS, the Agency awaits the Department's determination respecting the above application; and WHEREAS, the Agency expects to begin developer selection for the Monte Vista Property in 2006, unless Accessible Spaces secures funding for the project within the next year; and Resolution No. 04-100 Page 2 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1. The City Council hereby affirms its intention that the Monte Vista Property shall be developed as affordable housing for persons and families of low and moderate income. Section 2. The City Council hereby extends the period for development of the Monte Vista Property for an additional five years, from the expiration of the initial five-year period, under the authority granted to it by Health and Safety Code Section 33334.16. Section 3. The City Clerk shall certify to the adoption of this Resolution.
