RESOLUTION NO. 04-103
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE ELEMENT OF
THE GENERAL PLAN OF THE CITY OF POWAY
GENERAL PLAN (GPA 04-02)
WHEREAS, the City Council of the City of Poway recognizes that the need may
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code describes
the procedures for amending General Plans; and
WHEREAS, the City of Poway has initiated a General Plan Amendment, GPA 04-
02, which involves the consideration of the re-designation of land use and zoning on an
approximate 6-acre portion of an 80.5-acre parcel from Open Space-Resource
Management (OS-RM) to Rural Residential A (RR-A) and a corresponding 6-acre portion
from Rural Residential A (RR-A) to Open Space-Resource Management (OS-RM); and
WHEREAS, the City of Poway held a properly noticed public hearing in
accordance with the California Government Code and the California Environmental
Quality Act to consider that request; and
WHEREAS, the City Council further finds that the proposed General Plan
Amendment would assist in the preservation of a unique biological habitat by switching
the limited development area on the 80.5-acre parcel.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: The City Council has considered the Environmental Initial Study (EIS)
and Negative Declaration (ND), for General Plan Amendment 04-02 and public
comments received on the EIS and ND. The subject EIS and ND documentation are fully
incorporated herein by this reference. The City Council finds, on the basis of the whole
record before it, that there is no substantial evidence the project will have a significant
impact on the environment. The City Council hereby approves the Negative Declaration.
Section 2: The City Council hereby approves General Plan Amendment, GPA 04-02,
an Amendment to the Land Use Element of the Poway General Plan, re-designating an
approximate 6-acre portion of parcel 321-110-02, located on the northeast corner of the
parcel from Rural Residential A (RR-A) to Open Space-Resource Management (OS-RM)
and an additional approximate 6-acre portion of the parcel, located on the south east
corner of the parcel from Open Space-Resource Management (OS-RM) to Rural
Residential A (RR-A) as shown on Exhibit A.
