Res 04-094 RESOLUTION NO. 04-094 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING OLD POWAYTOWN PARK SPECIFIC PLAN AMENDMENT SPA 89-06A AND RESCINDING RESOLUTION NO. 89-135 APNs: 314-212-02 through 06; 314-220-02, 03, 33, 34, 35 & 69; 314-193-39 and a portion of 40 WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning Development Code) of the Poway Municipal Code provides the requirements for the initiation, preparation, and adoption of Specific Plans in accordance with Section 65450, et seq. of the California Government Code (Article 8, Specific Plan); and WHEREAS, Section 17.47.020.C (Initiation) of the Zoning Development Code provides that the City Council may initiate the preparation of, or amendment to, a Specific Plan on property by Resolution; and WHEREAS, on February 24, 2004, the City Council adopted the Old Poway Park Master Plan; and WHEREAS, the City Council finds that the land use matrix in SPA 89-06A must be amended to be consistent with the General Plan amendment/zone changes and the Old Poway Master Plan; and WHEREAS, on October 12, 2004, the City of Poway held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to these applications. NOW. THEREFORE, BE IT RESOLVED, by the City Council of the City of Poway, as follows: Section 1: The City Council has considered the Environmental Initial Study (EIS) and Mitigated Negative Declaration (MND), for CUP 89-10M(5), General Plan Amendment 04-01 (A and B), and SPA 89-06A, and SPA 88-01 D and public comments received on the EIS and MND. The subject EIS and MND documentation are fully incorporated herein by this reference. The City Council finds, on the basis of the whole record before it, that there is no substantial evidence the project will have a significant impact on the environment. The City Council hereby approves the MND and the associated Mitigation Monitoring Program attached to this Resolution as Exhibit A. Section 2: The City Council hereby rescinds Old Poway Town Park Specific Plan Resolution 89-135. Section 3: The City Council hereby approves Specific Plan Amendment 89-06A, an amendment to the land use matrix of the Old poway Town Park Specific Plan, to remain consistent with the General Plan amendment/zone changes and the new Old Poway Master Plan as shown in the report dated October 12, 2004. Resolution No. 04-094 Page 4 EXHIBIT B SPECIFIC PLAN 89-06(A) OLD POWAYTOWN PARK (Amended October 12, 2004) I. INTRODUCTION On December 23, 1986 and February 10, 1987, the Paquay Redevelopment Agency adopted resolutions authorizing the acquisition of 4.75 gross acres of land bordered by Midland Road on the east, Sycamore Road to the west, Aubrey Street to the north, and Temple Street to the south. The purpose of the acquisition was to provide the land necessary to create a heritage park that could depict Poway as it was in the late 1800's. To cultivate the park development process, the City Council, on September 22, 1987, re-designated the land use and zoning of the property from Rural Residential - C and Commercial General to Open Space, thus placing the parkland under a single, more appropriate zoning classification. City staff was then directed to develop several conceptual park designs for an Old Poway Park. From these conceptual drawings, a consultant was hired to develop a specific site plan, architectural renderings of new buildings, and redesigns of existing structures, land use plans, grading plans, lighting plans, and landscape plan. The City Council on February 23, 1989 conceptually approved a draft park plan entitled Old Poway Town Park and directed staff to prepare a specific plan to implement the proposal. This Specific Plan was adopted on August 22, 1989 and included the original 4.75 acres of park located on the west side of Midland Road and south side of Aubrey Street. This Specific Plan works in concert with the Old Poway Specific Plan, SP 88-01. On July 26, 1988, the City Council approved General Plan Amendment 88-02B and companion Zoning Ordinance Amendment 88-04 adopting the Open Space - Recreation land use designation and zoning category. In November 1991, two new land use categories were created in the City's General Plan. Open Space - Resource Management (OS-RM) and Public Facilities (PF), were created to replace the Open Space (OS) land use category. On January 26, 1993, the City Council adopted Zone Change 93-01Z changing the zoning of Old Poway Park to Open Space - Recreation (OS - R) to comply with the changes made to the General Plan. On February 24, 2004, the Poway City Council approved the Old Poway Park Master Plan. The Master Plan established the development plan to coordinate the expansion of, and modifications to, Old Poway Park in light of the acquisition by the Paguay Redevelopment Agency 13 parcels totaling approximately 4.4 acres located on the west side of Midland Road south of Temple Street and on the east side of Midland Road between Aubrey Street and Temple Street. Resolution No. 04-094 Page 5 The Old Poway Park Master Plan represents the completion of a planning process that is intended to enhance the historic character of the Old Poway area and to guide the expansion of Old Poway Park based on the expressed needs and desires of the community. The purpose of the Master Plan was to facilitate the expansion of the Old Poway Park boundaries, introduction of an art center and related facilities, expansion of the Farmers' Market, accommodation of new commercial development, establishment of a veterans' memorial, the creation of additional on- and off-street parking, enhancement of pedestrian circulation, and incorporation of additional open space areas. This specific plan has been amended to incorporate land use and development standards to allow implementation of the Master Plan. II. LEGAL DESCRIPTION The subject property is situated in the State of California, County of San Diego according to Map thereof No. 331 filed in the Office of the County Recorder of San Diego, May 27, 1887, and includes that portion of the east half of the alley adjoining said lot on the west as vacated by order of the Board of Supervisors, San Diego County, recorded January 18, 1945 as well as Assessor's Parcel Numbers 314-212-02 through 06; 314-220-02, 03, 33, 34, 35 & 69; and 314-193- 39 and a portion of 40. III. AUTHORITY AND SCOPE Section 65450, et. seq., of the California Government Code enables local governments to adopt specific plans for the systematic implementation of their general plan. The Old Poway Town Park specific plan is a component of the Poway General Plan and serves to implement the General Plan in the subject area. It is the intent of this specific plan to define appropriate land uses and development according to the approved Old Poway Park Master Plan approved February 24, 2004. This specific plan proposes development standards for the subject property. Where the development standards differ form those listed in the Open Space - Recreation (OS-R) zone in the Poway Municipal Code, the provisions contained within this specific plan shall take precedence. IV. RESPONSIBILITY FOR ADMINISTATION AND APPLICATION As the owner of the property, the City of Poway, through its Development Services and Community Services Departments will be primarily responsible for the administration, application, and interpretation of the specific development criteria and land uses contained herein. The City Council of the City of poway will retain ultimate authority and responsibility for the approval of any conditional use permit, development review, variance, specific plan amendment, or interpretation of the specific plan criteria. PROPERTY ANALYSIS The Old Poway Town Park established with this Specific Plan in 1989 encompassed 4.75 gross acres that included a combination of new and old, developed land and open space and is located on the west side of Midland Road between Aubrey Street and Temple Street. With the City's purchase of an additional 13 parcels, totaling approximately 4.4 acres, located on the west side of Midland south of Temple Street and on the east side of Midland between Aubrey Street and Temple Street, the Old Poway Park Master Plan was developed for the park and these adjacent areas to accommodate additional and expanded park uses for the community. The dominant natural feature of the original 4.75 acres of the park is Rattlesnake Creek that flows in a northeast to southwest direction, separating this part of the Park into two functions. The portion of the Park located northwest of the creek is situated within the floodway and remains as a large grassy open space filled with historically sized oak and sycamore trees. Picnic tables and barbeques have been constructed to serve the area that is used daily for picnicking and small family parties. The developed section of the Park is located southeast of the creek, outside the floodway. This section contains new and historic structures and serves as the main activity area of the Park. Structures within this area include the Porter House, named after Co!. Porter, who originally owned the land and built the house. His house has been updated and is now used for meetings and contains the Park Ranger's office. Co!. Porter was also responsible for bringing the narrow gauge steam train to the Park. The steam engine and passenger cars have been restored and are now used on a weekly basis to transport its passengers around the Park. In the early 1990's, the City constructed a late 1800's period train barn to house the steam engine and cars. A new train depot is proposed that would serve as a complimentary structure to the train barn and as a loading platform for train passengers. The International Order of Templars Hall, originally located near the Farmers' Market site, was relocated to the center of the Park and rehabilitated. The hall is now used for a multitude of public and private events including meetings, weddings, concerts, and dances. The Nelson House, a classic example of an early Poway farmhouse, was relocated from the east end of Poway Road to a site next to the Porter House and restored. The Nelson House now serves as a museum preserving the time and lifestyle of early Poway. The Hamburger Factory, a local favorite for families, youth sport groups, teenagers, and adults, is also an early fixture of Old Poway. Before its expansion and restoration in 1989, the building served as a restaurant and bar. The Poway Historical Society museum is located within a building extension behind the restaurant. The gazebo, centrally located between the Hamburger Factory and open space areas, unites the passive and active recreational functions of the Park. The gazebo is used for weddings, concerts, parties, and public presentations. Resolution No. 04-094 Page 7 VI. LAND USES The following land uses shall be permitted on the subject property where the symbol "P" appears, and subject to a minor conditional use permit where the symbol "M" appears. Additional uses may be added through an amendment to this plan as specified in Section IX. VII. SITE/BUILDING DEVELOPMENT STANDARDS 1. Building Setbacks Building setbacks shall be the same as the OS-R zone except that on a street frontage main structures may be built to the property line. Appurtenant building features such as porches, canopies, boardwalks, eaves, awnings, stairs, and chimneys attached to a main building or connecting the main building with a detached accessory structure may extend up to 10 feet into the public right-of-way. Distance between detached structures on the same lot measured in linear feet between eaves 15 feet Distance between train cars 5 feet 2. Parking Setbacks Parking spaces may encroach up to ten feet into the public right-of-way provided there is at least five (5) feet of undeveloped land separating the parking stalls from the edge of work. 3. Building Height The building height of any structure shall not exceed 35 feet or two stories, whichever is less. 4. Architectural Design Standards The Old Poway Specific Plan (SP 88-01), Part One, provides a detailed set of architectural guidelines for residential, commercial, and public facilities located within the project area boundaries. The plan exemplifies the architectural style of early Poway by illustrating specific examples of Resolution No. 04-094 Page 9 building designs, roof configuration, porches, building materials, colors, siding styles, and door and window treatment. To be consistent with the requirements of the Old Poway Specific Plan, and with the architectural style of existing and proposed surrounding buildings, the design of all structures within the Old poway Town Park shall comply with the architectural guidelines set forth in the Old Poway Specific Plan. 5. Lighting The exterior lighting program for park shall comply with the lighting standards set forth in Section 17.10.150 of the Poway Municipal Code, except for security lighting. Low wattage incandescent light and shielded florescent light may be used provided that the light intensity not exceed 75 lamberts at the property boundary. 6. Signage The style, size, and copy of all proposed signs within the park shall be designed to reflect the signage style found within Poway during the 1800's and early 1900's. All signs shall comply with the guidelines set fort in Part One of the Old Poway Specific Plan, 7. Public Improvements To further pedestrian safety and to reduce traffic speed, stop signs are anticipated at main roadway intersections in proximity to the Old Poway Park. The intersections could include Midland Road at Edgemoor Street, Temple Street, and Aubrey Street. To enhance public access and to reduce reliance of automobiles in and around the Park, bus turnouts will be incorporated along Midland Road near Aubrey Street. To facilitate access to exiting and proposed uses and parking fields within the Old Poway area, a separate lane is proposed east of Midland Road, behind the existing Old Poway Village center that will interconnect Edgemoor Street to Adrian Street. The lane provides access to off-street parking facilities east of Midland Road and can be used as an alternate north/south route permitting sections of Midland Road to be closed for special Park events. To improve the availability of parking for the collective park uses, angled parking along Midland Road will be created, the parking lot south of Temple Street will be enhanced, creation a parking field north of Aubrey Street will be created and the as well as one located generally east of Midland Road, between Aubrey Street and Temple Street. 8. Special Requirements The parking lot road surface and interior roadway surface shall be constructed of materials that represent the textures and appearance of the roads of early Poway and should not consist strictly of conventional smooth surfaced asphalt or concrete. The depth of surface material and base material shall be subject to the approval of the City Engineer. Resolution No. 04-094 Page 10 Parking lot landscaping shall comply with the standards set forth in the Poway Municipal Code and the City of Poway Guide to Landscape Requirements, requiring a minimum of one tree per three parking spaces. The tree placement, however, need not occur every third space and may be clustered in and/or around the parking area. The extension of landscape planters every nine spaces does not reflect the parking lot designs of the period, and therefore, are not required. The perimeters of the parking stalls need only to be generally noted. Due to the loose surface material on the lot, painting of the lines is neither feasible nor consistent with design of the park. VIII. IMPLEMENTATION PROCEDURES Development under this specific plan shall proceed according to normal procedures of the City of Poway with regard to development review. A development review may be required an any and all new structures as outlined in the poway Municipal Code. This specific plan proposes development standards for the subject property. Where development standards differ from those listed in the Poway Zoning Development Code, the provisions contained within this specific plan shall take precedent. IX. AMENDMENT PROCEDURES Any amendment, whether City-initiated or private, to Specific Plan 89-06 shall be processed in accordance with Chapter 17.47 (Specific Plan Regulations) of the Poway Municipal Code and shall be, if approved, adopted by City Council Resolution.
