Item 3.1 - Additional Material submited by public at meetingj�M3 - l ��i3Mr<(ti'p p f � ot; �sTtx February 5, 2019 Dear Honorable Mayor and Members of the City Council, I previously initiated an appeal to the City Council as per instructions in a letter to me from Mr. Noam Duzman of the City of Poway's City Attorney's Office. In the letter he indicated that if I failed to make this appeal I would lose the right to raise any issues not brought forth in this hearing. So I am now exercising my right to do so. In July of 2018, my son and I met with Mr. Bob Manis, Director of Development Services and Mr. Daniel Welte, Code Compliance. The meeting was initiated by me. At that meeting I explained that several significant events made it necessary for me to have more time to work on compliance. I asked Mr. Manis for a 90 day extension and by the end of the meeting it was agreed that I would work on getting the large trucks headed toward moving from the property. I began by making required repairs to the trucks. One of the trucks needed a hood replaced. Evidence of that repair is shown in one of Mr. Welte's photos, the damaged hood lying next to the fence line. About one month before the end of the 90 day period, I received paperwork from the California Environmental Protection Agency. I spoke with the gentleman who left the paperwork and found him to be pleasant and helpful. He asked to inspect items that I had just put on my property, primarily laser printers and printer parts. I asked him who noted him that the items were on my property and he told me he was informed by the Poway Code Compliance officer. At that time we needed to stop working on moving the trucks and began moving the printers and parts to a small 1400 square foot barn belonging to a friend. This was accomplished over the next several months, re-palleting and repackaging in order to stack in the barn. What didn't fit in the barn was taken to a Certified E -waste handler. Most of the trucks are ready to move. One exception is a two -axle truck with an attached and loaded 40 foot flat bed trailer. It is parked at the front of the back property and needs to be moved before the other vehicles can be removed. The truck has only 35,000 miles on it, but I am having a hard time getting it running. It also has an issue with the air brakes that requires repair. I need to find a shop that will do service calls for the Mercedes truck engine. The rainfall total for this year, beginning in October 2018, is approaching 10 inches. Most of my property is dirt and clay. Forklifts are needed to move the pallets on my property and every time it rained the forklifts would get stuck for several days at a time. Right now the ground is completely saturated and will take some time to dry out. During 2009 and early 2010 1 was approached several times by Poway Code Compliance about the visibility of the vehicles on my property and how a privacy fence should solve any complaint issues. I did install a chain link fence which is about 325 feet long and 6 feet in height with the maximum privacy screening. The fence cost approximately $6,600. After its installation in July 2010, there were no complaints until late 2017. The complaint came from a neighbor who has lived in his house next to my property for 10- 15 years. His complaint was registered following an altercation with two men who were working on my property late in the evening. I was not home at the time or I would have intervened before the disagreement escalated. I later apologized to said neighbor and told him it would not happen again. I had previously suggested installing privacy screening on the portion of chain link fence between his property and mine. He declined. I do not understand how one compliance officer approves of the solution to a problem and the next compliance officer judges it insufficient. The storage of my vehicles on my property was legal under the previous code. Four years ago the code was revised and I was no longer in compliance under it. The 14`h Amendment is an issue that I want to raise now so that I can raise it again later. Am I getting equal treatment under the Poway Code? I have a desire to remove most of the large trucks and much of the material scattered on my property. Because of ongoing health concerns, including a recent hospitalization, weather constraints, and lack of financial resources, it is taking me more time than I anticipated.
