Res P-04-79 RESOLUTION NO. P-04-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW (DR) 04-06 ASSESSOR'S PARCEL NUMBER: 275-461-07 WHEREAS, DR 04-06, submitted by JRS Architecture, Applicant, requests approval to construct a two-story, 5,475-square-foot, additional office building on a portion of a developed site, located at 15644 Pomerado Road, within the Commercial Office (CO) zone; and WHEREAS, on October 12, 2004, the City Council held a duly advertised public hearing to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: The City Council finds that the project is exempt from the California Environmental Quality Act (CEQA), as a Class 1 Categorical Exemption, pursuant to Section 15301(e)(2) of CEQA Guidelines, since the project involves the negligible expansion of an existing facility/use. The project qualifies for the exemption since it involves less than 10,000 square feet of additional building area, all public services and facilities are available, and the project site is not in an environmentally sensitive area. Section 2: The findings, in accordance with Section 17.52 ofthe Poway Municipal Code, for DR 04-06 are made as follows: A. The project is consistent with the Poway General Plan in that the project involves the construction of a medical office building, which is a consistent use within the Commercial Office General Plan land use designation. B. The project will not have an adverse health, safety, or aesthetic impact upon adjoining properties in that the development of the project is in full compliance with all City development standards. C. That the project is in compliance with the Zoning Ordinance in that the project complies with all City development standards of the CO zone, including those relating to building setbacks, building heights, lot coverage, and parking. D. That the development encourages the orderly and harmonious appearance of structures and property within the City as the adjacent properties along Pomerado Road consist of similar and compatible office uses. Section 3: The findings, pursuant to Government Code Section 66020 for the public improvements for DR 04-06, are to be made as follows: Resolution No. P-04-79 Page 2 A, The design and improvements of the proposed development are consistent with all elements of the Poway General Plan, as well as City Ordinances, because all necessary services and facilities will be available to serve this project. The payment of fees toward public improvements is needed as a result of the proposed development to protect the public health, safety and welfare as identified below: 1. The project requires payment of drainage, sewer, and traffic mitigation fees, which are assessed on a pro-rata basis, to finance and provide public infrastructure improvements to promote a safe and healthy environment for the residents of the City. Section 4: The City Council hereby approves DR 04-06 to construct a two-story, 5,475- square-foot, additional office building on a portion of a developed site located at 15644 Pomerado Road, within the Commercial Office zone, as shown on the plans dated June 17, 2004, subject to the following conditions: A. Approval of DR 04-06 shall apply only to the subject project and shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of Building Permit issuance. B. Within 30 days of the date of this approval, the applicant shall submit in writing that all conditions of approval have been read and understood. C. The conditions of DR 04-06 shall remain in effect for the life of the subject project, and shall run with the land and be binding upon future owners, successors, heirs, and transferees of the current property owner. D. Prior to construction, the applicant shall obtain a Building Permit. Prior to issuance of a Building Permit, the applicant shall comply with the following: 1. The site shall be developed in accordance with the approved plans on file in the Development Services Department and the conditions contained herein. 2. The applicant shall comply with the latest adopted Uniform Building Code, National Electric Code, and all other applicable codes and ordinances in effect at the time of Building Permit issuance. 3. All roof appurtenances for the new building, including air conditioners, shall be architecturally integrated, screened from view, and sound buffered from adjacent properties and streets. The building plans shall reflect roof screening details. 4. Landscaping shall be in accordance with the requirements of the City of Poway Guide to Landscape Requirements, All newly manufactured slopes shall be provided with ground cover, shrubs, trees, and permanent irrigation Resolution No. P-04-79 Page 3 in accordance with these standards. Additional 15-gallon shrubs or trees shall be installed to replace trees cut down in the planter boxes on Level 3. Complete landscape construction documents shall be submitted to and approved by the Planning Division. Landscape plan check fees are required upon submittal of the plans. 5. All new parking lot landscaping planters shall include a minimum of one 15- gallon-size tree for every three spaces. For new parking lot islands, a minimum 12-inch-wide walk adjacent to parking stalls shall be provided and be separated from vehicular areas by a six-inch-high, six-inch-wide Portland concrete cement curb. 6. All new two-way traffic aisles shall be a minimum of 25 feet wide. 7. All new parking spaces proposed for the rear portion of the site shall be double striped. The minimum dimensions for standard sized parking stalls shall be 8.5' x 18.5'. The parking lot design shall comply with the Americans with Disabilities Act for accessible spaces, with one van-accessible space. Building plans shall indicate areas of re-striping and signage for handicap spaces. 8. The existing trash enclosure shall be provided with gates consistent with City standards for trash enclosures, The building plans shall indicate the location of the trash enclosure and gate details. 9. The building plans shall depict the specific exterior building colors and materials consistent with the project plans dated June 17, 2004, and project materials sample board. 10. School impact fees shall be paid at the rate established at the time of Building Permit issuance. Please contact the Poway Unified School District for additional information at (858) 748-0010, extension 2089. 11. The project site has been previously graded per San Diego County Grading Plan No. L-8543. If there is no alteration to the site grading, no City Grading Permit is required prior to Building Permit issuance. If there is a change in grading that would involve earthwork excavation of two feet or more, or fill of more than one foot, and/or exceeding 50 cubic yards, then a Grading Permit issued by the City is required prior to start of grading work. If applicable, prior to Grading Permit issuance, a precise grading plan, together with erosion control plan, Storm Water Pollution Prevention Plan, and geotechnical reports of the project site, shall be submitted to the City for review and approval. Grading of the project shall be in accordance with the Uniform Building Code, City Grading Ordinance, and City Storm Water Resolution No. P-04-79 Page 4 Management and Discharge Control Ordinance. Plan checking and inspection fees shall be paid to the City, a grading security shall be posted, and a pre-construction meeting shall be held between the City Inspector, the applicant, and the applicant's contractor and engineers prior to Grading Permit issuance. 12. The following development fees shall be paid to the Engineering Division. These fees are currently in effect and subject to change without notice. The fees shall be adjusted accordingly, if changed, at the time of payment: Water base capacity (required to be paid only if a new water meter is to be installed) For 1" meter For 1 Yo" meter = $ 6,678.00 per meter = $10,388.00 per meter For other sizes, please contact the Engineering Division of the City's Development Services Department. E. Prior to the issuance of a certificate of occupancy, unless other timing is indicated, the applicant shall comply with the following: 1. The site shall be developed in accordance with the approved plans on file in the Development Services Department and the conditions contained herein. A final inspection from the appropriate City Departments will be required. 2. A separate Sign Permit will be required for all new signs and shall comply with Section 17.40 of the City of Poway's Zoning Code. 3. Prior to occupancy, the all new roof equipment shall be screened from view to the satisfaction of the Director of Development Services. 4. Prior to occupancy, the existing trash enclosure shall be provided with gates to screen the trash containers, consistent with City standards. 5. All parking spaces shall be striped and handicap spaces shall be provided with striping and signage, according to City standards and the American with Disabilities Act. 6. Prior to issuance of a certificate of occupancy, if a Grading Permit is required, a record drawing of the grading plan shall be submitted for review and approval by the City Engineer. Grading security, if any is posted for the grading work, shall be released after the grading work is completed and the record drawing of the grading plan is accepted by the City. F. The following improvements shall be constructed to the satisfaction of the City Fire Marshal: 1. Roof covering shall be fire retardant as per UBC Sections 1503 and 1504 and City of Poway Ordinance No. 64. 2. The building shall display its numeric address in a manner visible from the access street. Minimum size of the building numbers shall be six inches on Resolution No. P-04-79 Page 6 the front facade ofthe building. The building address shall also be displayed on the roof in a manner satisfactory to the Director of Safety Services, and meeting Sheriff's Department-ASTREA criteria. 3. Every building hereafter constructed shall be accessible to Fire Department apparatus by way of access roadways with all-weather driving surface of not less than 20 feet of unobstructed width, with adequate roadway turning radius capable of supporting the imposed loads of fire apparatus, and having a minimum of 13'6" of vertical clearance. The road surface type shall be approved by the City Engineer, pursuant to the City of Poway Municipal Code. 4. The building will be required to install an approved fire sprinkler system meeting P,M.C. requirements. The entire system is to be monitored by a central monitoring company. System post indicator valves with tamper switches, also monitored, are to be located by the City Fire Marshal prior to installation. A breakaway padlock shall be required for the fire sprinkler system post indicator valve. 5. A 'Knox' Security Key Box shall be required for the building at a location determined by the City Fire Marshal. 6. Fire Department access for use of fire fighting equipment shall be provided to the immediate job construction site at the start of construction and maintained at all times until construction is completed. 7. Permanent access roadways for fire apparatus shall be designated as 'Fire Lanes', with appropriate signs and curb markings. 8. A Minimum 3A40BC fire extinguisher is required for every 3,000 square feet and 75 feet of travel distance. 9. If an elevator is installed, it shall be sized to accommodate a normal hospital gurney. Minimum dimensions for the inside car platform shall be 6'8" wide by 4'3" deep. 10. If medical gases are planned to be used and/or stored within this building, they shall be installed to meet the requirements of the Uniform Fire Code, Article 74 - Compressed Gases. 11. The addition of on-site fire hydrants is required. The location of the hydrants shall be determined by the City Fire Marshal. 12. Fire sprinkler riser(s) shall be located within ten (10) feet of an exterior exit man door or shall be located inside an enclosed closet with an exterior Resolution No. P-04- 79 Page 7 access man door. The door shall be labeled with a sign indicating "Fire Sprinkler Riser". When the closet method is chosen, the applicant shall provide 36 inches of clearance from the standpipe, or attach additional risers, accessible by a 3'-0" man door. 13. A water systems analysis will be performed to establish available fire flow. 14. The existing Fire Department connection on Pomerado Road shall have its visibility increased. Contact the Fire Prevention Bureau at (858) 668-4470 for details. Section 5: The approval of DR 04-06 shall expire on October 12, 2006, at 5:00 p.m., unless, prior to that time, a Building Permit has been issued and construction on the property in reliance on the Development Review permit has commenced prior to its expiration. Section 6: Pursuant to Government Code Section 66020, the 90-day approval period in which the applicant may protest the imposition of any fees, dedications, reservations, or exactions imposed pursuant to this approval shall begin on October 12, 2004.
