Res P-04-96 RESOLUTION NO. P- 04-96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 04-99 FOR THE ESTABLISHMENT AND TEMPORARY USE OF PRACTICE BALL FIELDS WHEREAS, Temporary Use Permit 04-99, Poway Girls Softball League, Applicant, requests approval of 3 practice ball fields and off-street parking on a vacant, pre-graded, approximate 1-acre site located at the northwest corner of the Esopla Road and Old Coach Road intersection, in the Planned Community zone, until the sports fields at Aubrey Park are completed; and WHEREAS, on December 21, 2004, the City Council considered the above- referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows: Section 1: The City Council finds that Temporary Use Permit 04-99 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the use is temporary in nature and will have no adverse effects on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Chapter 17.26 of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 04-99, subject to the following conditions: A. The use shall be conducted as shown on the site plan and application on file in the Development Services Department. B. This permit is valid from February 1, 2005, to March 31, 2005, or until such time the sports fields at Aubrey Park are completed, whichever is sooner. The permit is valid between the hours of 4:00 p.m. to 5:30 p.m. Monday through Friday and 8:00 a.m. and 5:30 p.m. on Saturdays. Additional time for set-up and clean-up immediately before and after these specified times are additionally permitted. C. No lighting shall be used to illuminate the site and no amplified sound shall be permitted. D. The site shall be kept clean of litter and debris. E. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. F. Parking for the use shall occur on-site, or on the street adjacent to the site where street parking is permitted, Resolution No, P-04-96 Page 2 G. Best Management Practices to minimize erosion and impacts to storm water quality shall be employed at the discretion of the Director of Development Services. H. Portable toilets shall be placed on the site in the least visible locations from Old Coach Road, to the satisfaction of the Director of Development Services.
