AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING ZONE CHANGE REQUEST ZC 82-01
(CARRIAGE LANE CONDOMINIUMS)
LOCATED ON THE NORTHEAST CORNER OF CARRIAGE ROAD AND POWAY ROAD
APN: 317-090-39 AND 40
WHEREAS, on the 14th day of September, 1982, the City Council
considered the above referenced application; and
WHEREAS, the City Council has held duly advertised Public Hearings
pursuant to Section 65854 of the California Government Code.
NOW, THEREFORE, BE IT ORDAINED that the City Council of the City of
Poway, California does hereby find:
Section 1: Findings:
That the subject property is suitable for the uses permitted in
the proposed zones in terms of access, size and compatability
with existing land uses in the surrounding area in that the
subject property is located in an existing urban setting with
mixed residential and commercial shopping center land uses.
That the proposed zone changes would not have a significant
impact on the environment and the surrounding properties because
appropriate mitigation measures are contained in Section 3.
That the proposed zone changes are in conformance with the Poway
General Plan in terms of permitted land uses, maximum densities
and the goals and objectives of the City of Poway.
Section 2
Pursuant to Section 65850 through 65855 of the California Government
Code the City Council of the City of Poway hereby approves application
ZC 82-01.
Section 3
The City Council has reviewed the Environmental Impact Report (EAD
No. 80-13-5) for parcel one, certified January 7, 1981, and the
mitigation measures contained in applications TM 4180R and CUP 82-02
and thereby issues a Mitigated Negative Declaration for geology/soil
conditions, grading, drainage/hyrdology, traffic/circulation, noise,
light/glare, aesthetics, schools, police protection and sewage.

follows:

OLD ZONE: Use Regulations "C-36," Neighborhood Designator "Q," Density
(-), Building Type "T," Height "G," Setback "O," Open Space "A."
NEW ZONE: Use Regulation "R-V-10," Neighborhood Designator "A,"
Density 10 DU per net acre, Building Type "L," maximum Floor Area Ratio
(-), Height "G," Coverage "60%," Setback "V," Open Space "B," Special
Area Regulations "P."
Lot 2 and Lot 3 (APN: 317-090-39)
OLD ZONE: Use Regulation "R-S-3," Neighborhood Designator "Q,"
Density 2.9 DU per net acre, Lot size 15,000 square feet, Building
Type "C," height "G," Setback "H."
NEW ZONE: Use Regulation "R-V-3," Neighborhood Designator "A,"
Density 2.9 DU per net acre, Building Type "L," maximum Floor Area
(-), Floor Area Ratio (-), Height "G," Coverage "60%," Setback "V,"
Open Space "B," Special Area Regulation "P-"
APPROVED and ADOPTED by the City Council of the City of Poway, State
of California this 14th day of September, 1982, by the following roll call
vote:
